If you received a lien hearing notice in Palestine, TX while your collection case is still open, focus first on the deadline printed on the notice and the date you actually received it. Under IRM 5.1.9, a Notice of Federal Tax Lien and Your Right to a Hearing can open a Collection Due Process review window. The safest decision is to preserve proof of receipt and send a processable request before the filing period closes.

1. Start with the notice date, not the collection case history

A pending collection case does not change the clock attached to the lien notice. For a filed NFTL, the IRS uses Letter 3172 and the related filing dates to show when the 30-day request period begins. The request period starts after the five-business-day posting window described in IRM 5.1.9.3.2.1. That means your timeline should begin with the notice itself, not with earlier calls, payment plans, or prior collection correspondence.

Keep three records together: the Letter 3172, the envelope or other proof of when you received it, and a copy of everything you send back. If the notice also covers levy action, Appeals can consolidate the requests, but you should not assume one response covers every issue unless the notice and your filing actually do so.

2. Decide whether you need to request review, correction, or both

A CDP hearing is for independent review of the lien filing and the collection action tied to it. It is not the same thing as asking the IRS to correct a balance, and it is not a guarantee that collection pauses forever. IRM 5.1.9 explains that the hearing can address whether the NFTL filing was warranted and appropriate, and it can also allow discussion of collection alternatives when they are relevant.

If you disagree with the lien because the amount looks wrong, that issue may be limited in a CDP hearing depending on whether you had a prior opportunity to dispute it. In that situation, the practical move is to preserve the hearing right first and then organize the underlying records: filed returns, IRS account transcripts, notices showing the assessment, and proof of any payment or credit that should reduce the balance. A hypothetical example: if the notice lists a tax period you already resolved, mark that period clearly in your request rather than waiting to sort it out later.

3. Make the request processable and file it to the right place

The IRS says the taxpayer must send or hand-deliver the CDP hearing request to the office and address shown on the CDP notice. It may also be possible to use a fax number on the notice, or another electronic method if the revenue officer provides one. If the request is mailed to a listed IRS address and is timely postmarked, the postmark can control the filing date. That is why a dated mailing record matters so much.

Use Form 12153 and include enough detail so the request is processable. Do not wait for a perfect narrative before you mail it. A timely but incomplete request can sometimes be perfected later, but a late request may move into equivalent hearing territory, which is different. If you are unsure where the request went, IRM 5.1.9 says IRS systems such as AMS, ICS, or IDRS may help confirm whether the filing was received.

4. Use direct representation to protect communication and records

During a pending case, representation is most useful when it keeps the paper trail clean. Allen Lenth, EA-MBA, can help organize the notice, identify the correct filing window, and prepare the request so the IRS can process it without avoidable delay. In this phase, the important records are not just financial statements; they also include the notice copy, proof of mailing or faxing, a short issue list, and any IRS correspondence that shows the case is still active.

That same record discipline helps when you later discuss collection alternatives. Appeals may need financial information if you want to talk about payment options, but the first priority is preserving the right to review. A lien notice does not erase the debt, and a hearing request does not automatically stop every collection step. The practical next step is to verify the must-file-by date, send the request to the address on the notice, and keep evidence of transmission.

Questions about A lien hearing notice during a pending collection case

Does a lien hearing notice mean the IRS is levying my bank account?

No. A lien filing and a levy are different collection actions. The lien notice under IRC 6320 gives you a right to request a CDP hearing about the filing. A levy notice under IRC 6330 is a separate matter, even though Appeals may consolidate related requests when both notices are involved.

What records should I keep if I want to protect the filing deadline?

Keep the Letter 3172, the envelope or receipt showing when it arrived, a copy of Form 12153, and proof that you mailed, faxed, or delivered it to the address shown on the notice. If you later need to show timeliness, that record set is much more useful than a memory of when you spoke to the IRS.

If I miss the CDP deadline, is there still anything I can do?

Possibly, but the path changes. IRM 5.1.9 explains that a late request may be considered for an equivalent hearing if the time frame has expired, and separate timeliness handling may apply. Even then, you should still send the request promptly and keep proof of when you filed it.
