If you are in Odessa, TX and the IRS left you with an unanswered callback, do not treat that as protection for your CDP rights. The filing deadline comes from the notice, not from whether someone returned your call. Preserve the notice, the date you received it, and a dated Form 12153 request so you can protect the review path while the issue is still open.

What starts the CDP clock in Odessa

The key question is which notice you received. A Notice of Intent to Levy and Your Right to a Hearing, such as Letter 1058 or LT-11, starts the Collection Due Process period for levy action. A Notice of Federal Tax Lien Filing and Your Right to a Hearing, such as Letter 3172, starts the CDP period for the lien filing. IRM 5.1.9 and the IRS CDP FAQ both make clear that Form 12153 is the usual request form.

Do not assume that a prior phone call, voicemail, or callback request extends the filing period. The unanswered callback may explain why you were still trying to resolve the matter, but it is not a substitute for a timely written hearing request. If the deadline has not yet passed, use the notice itself as the anchor for your response date and keep proof of when you sent the request.

Make the request processable, not just fast

A CDP request should be complete enough to process. Under IRM 5.1.9, a signed Form 12153 or another signed written request can work, but the request should identify the tax period, the type of tax, and the reason you disagree with the collection action. If you are missing some items, IRS personnel may be able to perfect the request using internal records, but the signature matters. The regulations do not authorize a digital or electronic signature on the CDP request.

If you want Appeals to consider a collection alternative, include financial information when you can. The IRS FAQ says Form 433-A or Form 433-B can help Appeals review payment options more efficiently. That does not mean every case needs full financial disclosure on day one, but it does mean you should think carefully about what evidence supports the remedy you want. A bare objection without records can slow the review.

Use the callback record as support, not as your only defense

An unanswered callback is useful if you need to show that you tried to respond and were waiting for contact, but it does not replace the actual filing deadline. Keep a log showing the date and time you called, the number used, the voicemail left, and any name or badge information if available. Save screenshots, phone records, and copies of any letters or faxes you sent. Those records help establish your timeline if the IRS later questions timeliness or completeness.

If the request is late, IRM 5.1.9 says the taxpayer can ask that it be considered for other reasons, and the reason should be documented for Appeals. That is a different procedural track from a timely CDP hearing. A late request may be treated as an equivalent hearing request if the facts fit, but you should not assume the same hearing rights or the same consequences as a timely filing.

Practical next step for Odessa taxpayers

If the deadline is close, send the hearing request first and organize the evidence second. Include a copy of the IRS notice, your completed Form 12153, and any documents that show why the collection action should be reviewed. Then keep a clean file of what you sent and when. If you are unsure whether your request is timely, seek a case review before the date passes so the record is preserved while the issue is still open.

For local context, Odessa taxpayers may need county records or prior return copies from Ector County sources, but county clerks do not decide federal collection relief. The federal issue remains whether the hearing request was timely and complete under IRS procedure. Allen Lenth, EA-MBA, Enrolled Agent, can help organize the notice, callback record, and filing proof so the response fits the procedure instead of relying on a phone conversation.

Questions about The CDP deadline and an unanswered callback

Does an IRS callback stop levy action while I wait?

No. A callback request does not by itself suspend collection. The protection depends on the notice type and whether you filed a timely CDP request.

Can I submit something other than Form 12153?

Yes, a signed written request may work, but it must be dated and contain the needed information. Form 12153 is the standard way to request the hearing.

What if my request was late because I was trying to reach the IRS?

You can ask that the late request be considered for other reasons, but that is not the same as a timely CDP filing. Keep your call log and the notice for Appeals review.
