In Chatsworth, CA, the key question is whether you need the IRS to remove its claim from one specific property or end the federal tax lien itself. A discharge can clear a particular parcel or asset while the tax debt remains. A release is broader and generally follows full payment, expiration of the collection period, or another statutory basis under IRM 5.12.10.

Why the two remedies are not the same

A federal tax lien arises by law when a tax is assessed and remains unpaid after demand. The public Notice of Federal Tax Lien, or NFTL, is the filing that alerts third parties and is recorded with state or local offices. It does not change the nature of the underlying lien, and the lien can continue until the liability is satisfied or becomes unenforceable.

That is why a discharge and a release solve different problems. A discharge removes the lien from specifically described property. A release ends the lien itself, which is broader. IRM 5.12.10 explains that after a discharge, the lien continues in full force on all other property and rights to property of the taxpayer. So if you need to sell, refinance, or transfer one asset, discharge may be the narrower tool; if the debt is fully resolved, release is the cleaner end state.

What the IRS looks for in a discharge request

IRM 5.12.10 lists several statutory routes for discharge, and the request must fit one of them. Commonly, the IRS looks for proof that the government’s interest is protected through payment, that the government’s interest in the specific property has no value, or that sale proceeds will be held subject to the government’s claim. The IRS does not grant a discharge just because a taxpayer wants a title cleared; the facts must satisfy the code section.

The records matter more than the label on the request. Typical supporting documents include a purchase contract, payoff figures, escrow or settlement statements, a current title report, proof of equity, and any documents showing who owns the property and what other liens already exist. If you are asking for discharge because the property is being sold, the IRS will want to see how the transaction handles its interest. If the property is being transferred to someone else, you must show that you will be divested of all interest after the transaction.

What a release requires instead

A release is not the same as a discharge, and it is not triggered by a partial property transaction. Under IRM 5.12.10 and the IRS lien guidance, the lien is released when the liability is fully satisfied, the collection period expires, or a bond is accepted for payment. Paying the debt in full is the most direct route. The IRS also notes that the release of the lien is different from withdrawal of the NFTL; a withdrawal removes the public notice, but it does not erase the unpaid debt if any remains.

If your issue is a recorded lien on your house in Chatsworth, a county recorder can show that the NFTL was filed, but the recorder does not approve federal collection relief. The Los Angeles County Registrar-Recorder/County Clerk is a useful public-records source for finding what was recorded, while the IRS remains the decision-maker for discharge or release. This distinction helps you avoid sending the wrong request to the wrong office.

Practical next step before you file anything

Start by identifying the exact property and the exact goal. Ask whether you need title cleared on one asset, whether you are trying to close a sale, or whether the entire federal tax lien should end. Then gather the recorded notice, ownership documents, and the transaction papers that show why the IRS’s interest can be protected or why the liability is already resolved. If the NFTL lists a mailing address, do not assume that address itself proves the property is subject to the lien; the taxpayer must have had an interest in the property for the lien to attach.

For a hypothetical example, imagine a Chatsworth homeowner who wants to sell one parcel but still owes other tax periods. If the sale proceeds will satisfy the IRS’s interest in that parcel, a discharge request may fit better than waiting for a full release. If the taxpayer later pays the remaining balance in full, the release question becomes separate. Pub. 783 and Form 14135 are the discharge application tools, while release issues often start with account payoff and lien processing through the IRS.

Questions about Discharge of one property versus release of the lien

Does a discharge erase my tax debt?

No. A discharge removes the lien from specific property, but the underlying tax liability can remain. IRM 5.12.10 says the lien continues on your other property unless and until the debt is otherwise resolved.

Is a release the same as withdrawing the NFTL?

No. A release ends the lien when the statutory conditions are met. A withdrawal removes the public Notice of Federal Tax Lien, but it does not by itself erase an unpaid balance.

Can the county recorder approve my discharge request?

No. The county recorder only records documents. It can show what was filed in Los Angeles County, but the IRS decides whether the federal tax lien can be discharged or released.
