In Overland Park, KS, a payroll deposit in a frozen account usually means the bank has received an IRS levy and is holding the funds under the federal waiting period. The most important first step is to compare the levy service date with the payroll deposit date, then review whether the deposit was already in the account when the levy arrived. That timing often determines what the bank can legally send to the IRS under IRM 5.11.4.

Start with the levy date and the pay date

A bank does not immediately turn over levied funds. Under IRM 5.11.4.2, a financial institution generally waits 21 calendar days after service before surrendering funds in the account, subject to extension. That hold gives you a narrow window to review the account activity and raise issues before the bank sends money to the IRS.

The central question is whether the payroll deposit was already in the account when the levy was served. Funds on deposit when the levy is received may be subject to the levy up to the amount shown on the notice. Money deposited later is not automatically included, and a separate levy would be needed to reach later deposits. If the payroll posting happened after service, that fact matters.

Confirm what kind of account and ownership issue exists

A levy reaches property or rights to property belonging to the taxpayer. IRM 5.11.4 explains that the levy can attach to an account if the taxpayer has an unrestricted right to withdraw the funds, even when another person also has signature authority or made the deposits. So a paycheck direct-deposited into a joint or shared account may still be reachable if the taxpayer can withdraw from it.

That said, a non-liable third party may have a wrongful levy claim if the money truly belongs to someone else and the taxpayer has no rights to it. This is a different issue from simply saying the account was frozen. County records in Johnson County can help identify related filings, but they do not decide ownership of the bank funds.

Use records that answer the practical question

The most useful documents are the levy notice, the bank transaction history, the payroll stub, and any direct-deposit confirmation from the employer. If the deposit came from wages, the paystub can show the employer, pay period, and posting date. The bank ledger can show when the levy was received, when the hold started, and whether later deposits were added during the waiting period.

If the payroll deposit was needed for necessary living expenses, IRM 5.11.2.3.1.4 says economic hardship requires financial analysis and enough financial information to show that not releasing the levy would prevent payment of necessary living expenses. That is not automatic. A taxpayer should be ready to provide a concise account of income, essential bills, and any evidence showing why the frozen funds are needed now. A hypothetical example: if a paycheck was deposited after the levy date but before the bank sent the funds, the timing may justify asking the IRS to review whether some or all of the hold should be lifted, but the outcome depends on the facts and the account balance.

Choose the next procedural step carefully

If the deposit timing, hardship facts, or ownership facts suggest the levy should be reviewed, contact the IRS employee named on the levy or request a collection review conference as soon as possible. Do not assume that hiring a representative, or calling a local office, will stop collection by itself. Also, do not confuse a tax lien with a bank levy: a lien is a public claim against property, while a levy is the collection action that reaches the account.

If the bank later charges a processing fee because of an erroneous levy, IRM 5.11.4.2 discusses reimbursement procedures for bank charges resulting from an erroneous levy. But reimbursement is separate from release, and a release does not erase the underlying tax debt. In Overland Park, the practical move is to assemble the levy notice, paystub, and bank records first, then ask for a case review based on the exact timing and account facts.

Questions about A payroll deposit lands in a frozen account

Does a payroll deposit that arrives after the levy date belong to the IRS automatically?

No. IRM 5.11.4 says a levy reaches the funds in the account when the levy is received. Money deposited later is generally not surrendered under that levy, though a new levy could reach later deposits.

Can a joint account be levied even if my paycheck is the only deposit?

Yes, if the taxpayer has an unrestricted right to withdraw the funds. Under IRM 5.11.4, signature authority can make the account subject to levy even when another person made the deposits. Ownership disputes may require a wrongful levy claim.

What should I bring to an IRS notice conference about a frozen account?

Bring the levy notice, recent bank statements, the paystub for the deposit in question, direct-deposit details, and proof of necessary living expenses if hardship is involved. Those records help the IRS compare timing, ownership, and whether a levy release is justified.
