In Pasadena, CA, the first priority is usually preserving the CDP hearing deadline even if you do not yet have an affordable collection proposal ready. Under IRM 5.1.9, a timely written request can protect your right to Appeals review while you gather financial records and decide whether an installment agreement, offer, or another alternative is realistic. The deadline itself is the decision point, not a finished proposal.

Start with the notice date, not the payment plan

A CDP deadline is tied to the notice you received, so the first job is to identify whether the notice is a levy notice or a Notice of Federal Tax Lien filing. The timing rules are different, and IRM 5.1.9 explains that the levy deadline generally runs from the day after the levy notice date, while the NFTL deadline depends on the lien filing and the five-business-day mailing rule.

If you are in Pasadena or elsewhere in Southern California, keep the notice itself, the envelope, and any proof of mailing or fax transmission. Those records can matter if timeliness is later disputed. If the IRS notice lists both lien and levy issues, Appeals can consolidate them, but you still want the request filed in the correct window for each notice.

File the request before the proposal is complete

A hearing request can preserve the case even when you have not finished the financial statement that would support a collection alternative. That is often the safer choice when the main risk is missing the deadline. IRM 5.1.9 says a processable request must identify the disagreement, be signed by the taxpayer or authorized representative, and include the periods covered by the CDP notice unless a specific period is excluded.

If your issue is that you need time to build a realistic proposal, say so clearly. The IRS FAQ source notes that to consider collection alternatives, Appeals may need Form 433-A, Form 433-B, or similar financial information. You do not have to wait until every supporting document is assembled before you request the hearing. What matters is making the request timely and making the issue understandable.

Use the records that show whether the request is timely

The most useful records are practical, not elaborate: the CDP notice, the filing or mailing date shown on the notice, your copy of Form 12153 or other written request, and proof of when the request was mailed, faxed, or electronically sent. IRM 5.1.9 explains that if the request arrives after the filing window but was timely postmarked, faxed, or transmitted to the office listed on the notice, that earlier transmission date can control.

If the request is late, it may still be treated as an equivalent hearing request if the facts fit, but an equivalent hearing does not carry the same judicial review rights. That is an important limit. If the deadline has already passed, the better next step is usually to document the mailing date, ask for the timeliness determination, and consider whether CAP or TAS contact is appropriate under the procedures described in IRM 5.1.9.

A practical decision path for Pasadena taxpayers

Think of the case in three steps. First, preserve the deadline with a written request. Second, gather the records that let Appeals evaluate your account: recent income proof, bank statements, business records if applicable, and any notices showing why you disagree with the collection action. Third, build the collection alternative after the request is safely in process.

For example, a hypothetical taxpayer who cannot yet afford a proposed monthly payment might still file the hearing request now, explain that the payment amount is not sustainable, and then submit financial details after reviewing cash flow. That approach keeps the issue alive without pretending a complete proposal already exists. The key limit is that filing the request does not stop all collection in every situation, and it does not guarantee a particular alternative will be accepted.

Questions about A hearing request without an affordable proposal yet

Can I request a CDP hearing before I finish my financial statement?

Yes. A timely written request can preserve your right to Appeals review while you prepare the financial records needed to discuss collection alternatives. The request should still explain why you disagree with the IRS action.

What if I miss the CDP deadline by a little bit?

A late request may be treated as an equivalent hearing request, but that is not the same as a timely CDP hearing and generally does not include judicial review. The request should still be sent to Appeals for a timeliness determination.

Do I need a full payment proposal before I ask for a hearing?

No. You should not wait for a complete proposal if that delay risks missing the deadline. You can ask for the hearing first and then submit supporting financial information for collection alternatives afterward.
