If your Hurst, TX bank account is frozen and the money is needed for rent, groceries, medication, or utilities, treat it as a bank levy hardship issue right away. Under IRM 5.11.4, a bank generally holds levied funds for 21 calendar days before sending them to the IRS, and the levy can be released in whole or part if it creates an economic hardship. The key question is whether the frozen funds leave you unable to pay reasonable necessary living expenses.

Start with the 21-day bank hold

A bank levy is not the same as a wage levy. For a bank account, the levy usually reaches the funds already on deposit, and the bank must wait through the holding period before surrendering money. That pause matters because the IRS can still act during that window if the facts show hardship or another release reason. See IRM 5.11.4.2.

Use the timeline to make decisions. On day one, confirm exactly which account was frozen and whether the bank received a levy notice. During the hold, gather proof of basic expenses and speak with the IRS employee named on the levy if you can do so promptly. Do not assume the freeze will automatically clear itself or that the account balance is protected just because it is needed for living costs.

Show hardship with records, not just urgency

The IRS needs financial information that shows the effect of the levy on your actual budget. Helpful records usually include recent bank statements, pay stubs, benefit statements, rent or mortgage records, utility bills, pharmacy receipts, child care costs, and a simple monthly income-and-expense summary. The point is to show that the levy prevents you from meeting ordinary living costs, not just that the account balance feels low.

If the bank account contains an entire paycheck, hardship may be more obvious because levied deposit account funds can leave you with nothing for essentials. IRM 5.11.4 notes that once income is deposited into a bank account, the wage exemption no longer applies in the same way. That is one reason the IRS may release all or part of the levy when the deposit would otherwise cause economic hardship.

Choose the correct relief path before funds move

There are several different outcomes, and they are not the same. A hardship release addresses a levy that is making it impossible to pay necessary living expenses. A wrongful levy claim is different and is used when the money belongs to a third party and not the taxpayer. A release of levy is also different from a tax lien withdrawal, release, discharge, or debt satisfaction; those terms do not mean the same thing and do not erase an unpaid liability by themselves.

If the account may include funds owned by someone else, or if multiple people have access to the account, ownership becomes important. IRM 5.11.4 explains that a bank account can be levied when the taxpayer has an unrestricted right to withdraw the funds, even if another person also has signature authority. In a hypothetical example, a joint account with mixed deposits may require the IRS to examine ownership before the money is surrendered.

Practical next step for a Hurst taxpayer

Act before the hold period ends. Contact the IRS employee listed on the levy, send the financial records that show your necessary expenses, and ask whether the levy can be released in whole or in part because it is creating economic hardship. If the issue cannot be resolved quickly and your situation meets Taxpayer Advocate Service criteria, a TAS referral may be appropriate under IRM Part 13, but it does not replace the levy analysis itself.

For local context, Hurst is in Tarrant County, so public records may help you organize ownership or account-name documents, but county clerks do not decide federal collection relief. If the freeze involves a possible third-party ownership issue, that is a separate analysis from hardship. The immediate goal is to show what money is needed, why it is needed, and what outcome the bank levy is causing right now.

Questions about The bank freezes funds needed for basic living costs

Does the bank have to freeze my money immediately?

Banks generally must follow the levy notice and hold the funds for the required period before surrendering them, rather than turning the money over right away. That holding period is the time to raise hardship concerns and submit financial records.

If my spouse’s name is on the account, is the money automatically protected?

No. Joint ownership or multiple signature authority does not automatically prevent a bank levy. The IRS looks at who has a right to withdraw the funds, and a third party may need to raise a wrongful levy issue if the money is not the taxpayer’s.

Will calling the IRS stop collection by itself?

No. A call can start the review, but it does not guarantee a release or suspend enforcement on its own. You still need to show the financial facts that support hardship or another legal basis for relief.
