In Midway, FL, a wage levy on one household earner does not automatically take the other paycheck, but it can still strain the whole budget. The first step is to identify exactly whose wages are levied, whether the liability is joint, and what exempt amount can still be claimed through the employer process described in IRM 5.11.5.

Start with whose pay is actually levied

An IRS wage levy is continuous, so it keeps reaching future wages until the IRS releases it under IRC 6343. That means the employer keeps applying the levy to later payrolls, not just the paycheck that was due when the notice arrived. IRM 5.11.5 also explains that wages include salary, fees, commissions, bonuses, and similar compensation.

For a two-earner household, the most important distinction is whether both spouses are actually named or whether only one earner received the levy notice. The IRS does not automatically levy both household incomes just because the family shares expenses. Under IRM 5.11.5.4, for joint liabilities the IRS generally levies the spouse with the larger income, and both incomes are levied only in flagrant cases of neglect or refusal to pay with manager approval.

Use the levy paperwork, not guesswork, to claim the exempt amount

Form 668-W is designed for individuals who may be entitled to the minimum exemption from levy. It includes a Statement of Dependents and Filing Status, and the employer gives that statement to the taxpayer to complete and return within three days. If the statement is not returned in time, the exempt amount is figured as if the taxpayer were married filing separate with no dependents, which can reduce the protected portion of wages.

The employer uses that statement rather than the employee’s W-4. That distinction matters because withholding choices and levy exemptions are not the same thing. A household can have one person under levy while the other keeps normal withholding, so the family should separate the payroll facts from the tax return facts before deciding what cash is truly available.

Decide whether the problem is exemption, joint liability, or collection timing

If the levy is on only one spouse’s wages, the immediate question is usually whether the exempt amount was computed correctly and whether the employer received a proper statement. If both spouses are liable on the same tax debt, the next question is whether the IRS used the larger-income spouse first or whether the facts rise to the level where both incomes were levied. That distinction affects what relief or correction to ask for.

If the household is already short on essentials, the issue may also be hardship, but a hardship request should be based on records, not assumptions. A levy can continue while that review is pending unless the IRS separately releases it. Also, a bank levy is different: it only reaches money in the account when served, while a wage levy reaches future paychecks until released.

Build a focused record packet before you contact the IRS

A practical review packet should include the levy notice, the latest pay stubs for both earners, the completed or missing Statement of Dependents and Filing Status, the return or assessment information tied to the debt, and a simple household budget showing unavoidable monthly bills. If the liability is joint, include both spouses’ income records so you can see whether the IRS levy choice matches the IRM guidance.

As a hypothetical example, if one spouse is levied and the other is not, the family may still be able to preserve more cash flow by making sure the employer uses the correct exempt amount and by confirming that the levy is not being applied more broadly than the notice allows. The key is to verify the exact payroll mechanics before assuming the entire household income is at risk.

Review the notice before the next payday

The most useful next step is a case review or IRS notice conference focused on the levy notice, the wage records, and the household budget. That conversation should aim to confirm the correct levy scope, the exempt amount, and whether the facts support a release, adjustment, or other collection option. It should not assume that hiring help itself stops collection.

If the levy came from a joint return or a jointly assessed balance, bring both spouses’ income information and any proof that the household is separated or living apart, because that can affect how the IRS evaluates collection from both incomes. For Midway taxpayers, the point is not to guess at the result; it is to document the payroll facts and respond to the levy on the record.

Questions about Two household earners and one wage levy

Does one wage levy reach both household paychecks?

Usually no. A wage levy generally reaches the wages of the person named on the levy. If the tax debt is joint, the IRS may consider both spouses’ income in limited circumstances, but that is not automatic.

What should I return to the employer after a Form 668-W?

Return the Statement of Dependents and Filing Status promptly. The employer uses that form to calculate the exempt amount; it is not the same as your W-4 withholding election.

Can the IRS keep taking future paychecks?

Yes. Under IRC 6331(e) and IRM 5.11.5, a wage levy has continuous effect until the IRS releases it. That is why timing and correct payroll information matter so much.
