In Kenmore, NY, a wage levy on one household earner does not automatically reach the other paycheck, but it can still tighten the family budget quickly. The right comparison is between three procedures: claiming the exempt amount through the employer, checking whether the levy matches a joint-liability case, and deciding whether a levy release request is warranted. IRS procedures in IRM 5.11.5 control that analysis.

Start with the levy notice and pay records

A wage levy is different from a bank levy. Under IRC 6331(e), a wage levy has continuous effect and keeps attaching to future wages until it is released. By contrast, a bank levy reaches only money in the account when the levy is served. For a household trying to preserve rent, food, and utilities, that distinction matters immediately.

Review the Form 668-W and the most recent pay stubs together. The levy paperwork should tell you whether the levy is aimed at wages, salary, or other income. Keep the employer notice, payroll records, and any IRS letters in one place. If the household is in the Buffalo and Western New York area, Erie County public-records systems may help with local document retrieval, but county offices do not decide federal collection relief.

Compare the exempt-amount path with the joint-liability path

Form 668-W includes a Statement of Dependents and Filing Status. The employer gives that statement to the taxpayer, who should return it within three days. If it is not returned on time, the exempt amount is figured as if the taxpayer were married filing separate with no dependents. The employer uses that statement, not the Form W-4, because withholding choices are not the same as levy exemptions.

If the tax debt is a joint liability, IRM 5.11.5 says the IRS generally levies the income of the spouse with the larger income. Levying both incomes of spouses living in the same household is reserved for flagrant cases of neglect or refusal to pay, and group manager approval is required. That is a different issue from the exempt amount. One question asks how much pay is protected; the other asks whose wages can be levied at all.

Decide whether the problem is cash flow, scope, or release

If only one household earner is levied, the practical goal is usually to preserve enough net pay to keep the household stable while the case is reviewed. The records that matter most are the levy notice, the completed Statement of Dependents and Filing Status if one was submitted, the affected pay statements, prior IRS notices, and proof of which spouse owes the tax if the debt is not joint.

A hypothetical example: if one spouse is subject to a wage levy but the other spouse is not liable on the account, the household may need to show the IRS that the current collection action is reaching the right taxpayer and that the exempt amount was calculated correctly. That is a procedural review, not a guarantee of relief. A wage levy can remain in force until it is released, and hiring a representative does not by itself stop collection.

Use the next contact to request a focused case review

The most useful next step is a targeted review of the levy papers before the next payroll cycle. Ask for a case review or an IRS notice conference focused on whether the levy was served correctly, whether the exempt amount was handled correctly, and whether the household income being collected matches the liability on the account. Keep the discussion narrow and document-based.

Do not confuse a levy release with wiping out the debt. A release ends the levy; it does not erase the tax owed. If the issue is actually a federal tax lien on the record, that is a separate procedure from a wage levy. The IRS also distinguishes between release, withdrawal of the NFTL, discharge of specific property, and satisfaction of the debt. Those are not the same outcome, and one does not automatically produce the others.

Questions about Two household earners and one wage levy

Does a wage levy automatically take both spouses’ paychecks?

No. Under IRM 5.11.5, the IRS generally levies the income of the spouse with the larger income for joint liabilities. Levying both spouses in the same household is reserved for flagrant cases and requires group manager approval.

Should the employer use my W-4 to calculate the exempt amount?

No. For a wage levy, the employer uses the Statement of Dependents and Filing Status that comes with Form 668-W, not the employee’s W-4. Those forms serve different purposes.

If the levy is released, is the tax debt gone?

No. A levy release ends the collection action against wages, but it does not eliminate the underlying tax debt. Satisfaction of the debt is a separate event, and lien procedures are separate as well.
