If you received a lien hearing notice in Pacoima, CA during a pending collection case, your first job is to protect the Collection Due Process deadline before you argue the tax. Under IRC 6320 and IRM 5.1.9, the notice tied to the filed NFTL gives you a written right to request Appeals review, but that right depends on a timely, processable request sent to the correct IRS address.

Start with the notice that actually controls the clock

A lien hearing notice is not the same thing as a levy notice, and the response period is not measured the same way. For a filed Notice of Federal Tax Lien, IRM 5.1.9 explains that the IRS uses Letter 3172 to tell you when the hearing request must be filed. The timing rule is based on the filing date of the NFTL and the five-business-day mailing window the IRS uses to estimate when the lien was filed with the local recording office.

Because the local recording office, not the IRS, records the NFTL, the letter supplies the key “must file by” date. That makes the document itself the starting point for your deadline analysis. If your notice package includes more than one period, the request can cover all applicable periods unless you specifically exclude one. If you are not sure whether you received a CDP lien notice or a levy notice, compare the title of the letter and the appeal rights section before you prepare anything.

In Los Angeles County, a recorded lien may be visible in public records, but that record does not tell you whether your hearing request is timely. The controlling proof is the IRS notice, the mailing date, and your delivery record.

Use records that prove the request was timely and processable

A strong response is document-led, not argumentative. Gather the Letter 3172, the envelope, a copy of the NFTL page if you have it, and proof of how you plan to send the request. IRM 5.1.9 says the taxpayer must send or hand-deliver the CDP hearing request to an IRS office and address on the notice. It also allows faxing if the notice lists a fax number, and it notes that a taxpayer may hand-deliver the request to a local taxpayer assistance center within the 30-day period.

If you mail the request, keep the postmark and the delivery proof together. If you hand-deliver or fax it, keep the confirmation page or receipt. The practical issue is not only whether you asked for a hearing, but whether the request can be processed without a follow-up perfection step. A timely but incomplete request may still be fixable, but you do not want to rely on that if you can avoid it.

If you believe you already submitted the request somewhere else, IRM 5.1.9 says IRS staff may check system history and ask you for a copy. That is why retaining your own copy matters. A misplaced request is much easier to rescue if you can show what was sent, when it was sent, and where it went.

Know the limits of a CDP lien hearing before you choose your issues

A CDP hearing can review whether the NFTL filing was warranted and appropriate, and it can also open the door to collection alternatives. But it does not automatically let you reopen every tax issue. IRS guidance notes that underlying liability arguments are limited, especially if you had a prior chance to dispute the amount. That means the best response is usually to focus first on the procedural record: whether the notice was valid, whether the request was timely, and whether any collection alternative should be considered.

Do not assume that asking for a hearing stops all collection activity forever. The notice gives you a right to request review; it does not guarantee that enforced collection ends permanently, and a late or incomplete filing can change what Appeals can consider. Also remember the distinction between a lien filing, a levy, and a levy on bank or wages. A filed lien is public notice of the government’s claim; it is not the same as a levy that seizes property.

If your deadline may have passed, the IRS materials distinguish between a CDP hearing request and an equivalent hearing request, and in some cases Appeals makes a separate timeliness determination. That is a different procedural path, so do not guess. The better move is to document the dates and let the paperwork show whether you still have CDP rights.

Practical next step for a Pacoima taxpayer

Make one clean file today: the IRS notice, proof of mailing or delivery, recent IRS correspondence, account transcripts if available, and any financial records you may need if Appeals asks about a collection alternative. If your goal is to preserve the deadline, send the hearing request exactly as the notice directs and keep proof. If you need help organizing the record, a case review can focus on timing, notice language, and whether the request is complete before the file moves forward.

If you are unsure which IRS office to use, verify the address on the notice itself rather than relying on a general office search. The IRS local-office locator and the Taxpayer Advocate locator can help you find official contact points, but they do not change the deadline printed on your notice. The key is to act on the notice you received, not on memory or assumptions.

Questions about A lien hearing notice during a pending collection case

Does a recorded tax lien mean the IRS already took my property?

No. A Notice of Federal Tax Lien is public notice of the government’s claim. It is different from a levy, which is a collection action that can seize property or rights to property. The lien notice can trigger CDP hearing rights, but it is not the same as a seizure.

Can I send my hearing request to any IRS office?

No. IRM 5.1.9 says the request should be sent or hand-delivered to an IRS office and address listed on the CDP notice. If the notice includes a fax number, you can use that number. Keep proof of delivery either way.

If I miss the CDP deadline, do I lose all options?

Not necessarily, but the path changes. The IRS guidance describes equivalent hearing and other available rights in some late-request situations. You should not assume the same issues will be reviewed the same way, so the timing and the documents matter.
