In San Jose, CA, do not let an unanswered IRS callback put your CDP deadline at risk. If the notice gives you time to request a Collection Due Process hearing, file Form 12153 or another signed written request before the deadline, even if you are still waiting to hear back. The IRS procedures in IRM 5.1.9 make timeliness the key issue; a phone call is useful, but it is not the same as a filed hearing request.

Protect the deadline first, then sort out the callback

A CDP notice starts a short window to ask for Appeals review. The safest approach is to treat the written filing date as the controlling date, not the date you left a voicemail or requested a return call. Under IRM 5.1.9, taxpayers generally use Form 12153 to request the hearing, but a dated written request signed by the taxpayer or authorized representative can also work.

If you wait for the IRS to call back, you may lose the procedural protection that a timely CDP request can provide. That matters because a timely request can move the case into Appeals review and may affect how levy action proceeds. By contrast, a late request may be treated differently and requires the reason for lateness to be documented for Appeals consideration.

Form 12153 versus a signed written request

Form 12153 is the standard route because it already asks for the tax periods, the type of tax, and the reasons you disagree with the collection action. If you are racing the deadline, though, the IRS also accepts a signed written request that clearly asks for a CDP hearing. IRM 5.1.9 says the request must be dated and should identify the tax, period, and disagreement reasons.

If a form is incomplete, that does not always mean it is unusable. IRS staff may be able to secure missing items from IRS systems, such as the taxpayer name, identification number, or tax period. A missing signature is a more serious problem than a missing daytime phone number, and electronic or digital signatures are not authorized for a CDP hearing request. If you have both spouses on a joint period, both signatures are generally required when both are asking for the hearing.

A useful distinction is this: a callback can help you explain your position, but a written filing preserves the procedural right. If you have nonfrivolous reasons for disagreement, the IRS may secure the reason orally and document it, but that does not replace the need for a valid signed request when signatures are required.

What records help when the call was not returned

Keep the CDP notice, a copy of your filed Form 12153 or written request, proof of mailing or fax transmission, and notes showing when you tried to contact the IRS. If you relied on a notice number such as a levy notice or Letter 3172, save the envelope and the notice itself. Those records help show what you received and when you acted.

If the issue is a lien filing, a levy notice, or both, do not assume the procedures are identical. A Notice of Federal Tax Lien filing gives rise to CDP rights about the lien filing, while a levy notice gives rise to rights before levy action. The IRS FAQs explain that the levy process is not the same as the lien process, and the notice you received controls the type of hearing request you need.

If you are asking for a collection alternative, include financial information with the request when available. The IRS says that Forms 433-A or 433-B can help Appeals evaluate your situation more quickly. That is different from asking only for a hearing on whether the filing or levy was proper. In a hypothetical example, a taxpayer who files the hearing request on time but forgets the financial statement can still preserve the deadline first and supplement the case later.

What to do next if the deadline is close

If the deadline is near, file the request now and do not wait for a callback. Then organize your supporting papers so you can respond quickly if Appeals or Collection asks for more information. If you already missed the deadline, IRM 5.1.9 says the reason for lateness should be documented on a timeliness determination cover sheet for Appeals consideration, so explain the facts clearly and keep your explanation focused on timing.

For San Jose taxpayers, a practical next step is to use the IRS local office locator or the Taxpayer Advocate Service contact page only as a reference point for help channels, not as proof that any office controls your case. A county recorder records public documents, but it does not decide IRS collection relief. If you need help organizing the notice and your response packet, a case review can help you choose the right filing path before the deadline closes.

Questions about The CDP deadline and an unanswered callback

Does a returned IRS call count as a CDP request?

No. A callback can help explain your situation, but it does not replace a timely signed written request. Form 12153 is the usual method, and a dated written request can also work if it clearly asks for a CDP hearing.

What if I received a lien notice instead of a levy notice?

The notice type matters. A lien filing notice and a levy notice trigger related but different CDP rights, so use the notice you received to decide which hearing request applies. Do not treat them as the same procedure.

Can I send financial forms with the CDP request?

Yes, if you are asking for a collection alternative. Forms 433-A or 433-B can help Appeals evaluate payment options more efficiently. They are helpful records, but they do not substitute for a timely filed hearing request.
