In Roseville, CA, the most serious mistake is treating an unanswered IRS callback as if it pauses your Collection Due Process clock. It does not. If you received Letter 1058 or LT-11, the deadline to request a CDP hearing still controls, and Form 12153 is the safest way to protect that right. A callback can be helpful, but it is not a substitute for a timely written request.

Do not let a promised call replace a filed request

The IRS guidance in IRM 5.1.9 and the IRS CDP FAQs both point to the same practical rule: preserve the deadline first. A taxpayer generally uses Form 12153 to request a Collection Due Process hearing, and if the form is not used, a signed written request can still work if it is dated and contains the required information.

If the IRS has not returned your call, assume the deadline is still running. That is the costly mistake that changes a manageable notice problem into a lost appeal opportunity. A phone conversation may help clarify the issue, but the hearing request must be in writing and timely if you want CDP rights rather than only an equivalent hearing path.

What the request should contain before you send it

A valid request should identify the taxpayer, the tax periods at issue, and the reason you disagree with the proposed levy or lien action. IRM 5.1.9 explains that some missing items can be perfected later if IRS records already supply them, but signatures still matter. For joint tax periods, both spouses generally need to sign if both are asking for a hearing.

If you are disputing the filing of an NFTL or a levy action, be specific. Form 12153 has room to state your position, and a checked reason can be enough if it is not vague or frivolous. If you have financial records that support a collection alternative, include them with the request rather than waiting for a follow-up call. That can shorten the time Appeals needs to evaluate the case.

Why the notice type changes the practical response

A levy notice and a lien notice are not the same thing, and the response strategy should match the notice you received. The IRS says Letter 3172 gives a taxpayer time to request a CDP hearing about a federal tax lien filing, while LT-11 or L-1058 relates to levy rights. CP504 alone is not the final levy notice, although the IRS says it is still wise to respond to it promptly because it may be followed by a formal notice.

Do not assume that an unanswered callback means the IRS will accept a late filing later. If the request is late, IRM 5.1.9 says the taxpayer may ask for consideration for other reasons, and the reason should be documented for Appeals. That is a different posture from a timely CDP request, so timing is the first issue to confirm before anything else.

A practical Roseville next step

If you are organizing records in Roseville or elsewhere in Placer County, keep the official notice, a copy of Form 12153 or your signed written request, proof of mailing or fax transmission, and any financial information you want Appeals to review. If you cannot reach the IRS by phone, do not wait on the callback to assemble the filing.

A hypothetical example: if a taxpayer has a Letter 1058 and leaves a voicemail asking for more time, but the deadline passes before the IRS replies, the voicemail does not preserve CDP rights by itself. Filing the request on time does. If you need help framing the issue, a case review can help you decide whether the notice calls for a lien, levy, or other collection response, but it does not itself stop collection.

Questions about The CDP deadline and an unanswered callback

Does an IRS callback pause the CDP deadline?

No. A callback request may help with communication, but it does not replace a timely written CDP hearing request. Preserve the deadline by filing Form 12153 or another dated written request that includes the needed information.

Can I file Form 12153 if I do not have all the details yet?

Often, yes. IRM 5.1.9 says some incomplete requests can be perfected later if the missing information is available from IRS systems or can be supplied afterward. Signatures are still important, and the request should clearly identify the notice and the issue.

What is the difference between a lien notice and a levy notice?

A Notice of Federal Tax Lien filing notice concerns the IRS recording a lien, while an LT-11 or L-1058 concerns the right to a hearing before levy action. The notice type matters because the hearing request should match the collection action being challenged.
