In Pacoima, CA, selling property when the proceeds will not cover the debt usually turns on the lien’s value in that specific property, not on the full balance owed. A recorded federal tax lien is a public claim against your property, but it is not the same as a levy. If the closing will leave no equity for the government, the practical question is whether the IRS can discharge the property so the sale can close without changing the unpaid balance.

Start with the closing structure, not the tax balance

Under IRM 5.12.10, the IRS looks at the government’s interest in the property being sold. That means the file should show the mortgage payoff, expected closing costs, and any junior claims that affect who gets paid first. If the senior lender’s claim uses up the sale price, the federal lien may have no remaining value in that property, even though the tax debt itself still exists.

For a short sale, the source material says the IRS may consider the matter under IRC 6325(b)(2)(B). The important point is that the lender must agree to accept less than what is owed, and the IRS may treat the government’s interest as valueless if the senior lien consumes the equity. That does not mean the debt disappears. It means the lien’s reach on that property may be limited for closing purposes.

Use the right records to support a discharge request

A document-led case review should focus on the settlement statement, payoff letters, listing history, and any recent comparable sales that show the market has weakened. IRM 5.12.10 encourages use of forced sale value when depressed comparable sales suggest the property is worth less in a forced or distressed sale than in a standard appraisal, but Advisory decides whether to use that method. If the file does not support forced sale value, the disagreement should be documented with market data.

If the sale is structured as a no-equity closing, the IRS wants proof that the property will transfer and that there is no remaining value for the lien to attach to in that parcel. In that setting, the issue is not whether the taxpayer still owes money; it is whether the IRS should discharge the property so the transaction can complete. A county recorder, including the Los Angeles County Registrar-Recorder/County Clerk, records deeds and lien documents, but it does not approve federal collection relief.

Separate discharge, proceeds, and withdrawal

A discharge removes the lien from specific property; it does not erase the tax debt. A withdrawal removes the public Notice of Federal Tax Lien, but the liability can remain unpaid. Satisfaction of the debt is different again. Those distinctions matter when a sale is pending because the closing may require a discharge even though no one is claiming the balance has been paid in full.

IRM 5.12.10 also explains that if a sales structure places proceeds in a fund subject to the IRS’s lien rights, the government may treat those proceeds according to their priority. That is different from a straightforward short sale where the senior lender’s lien leaves no equity for the IRS. If the lender allows part of its proceeds to go to the taxpayer as an incentive, that payment may be levyable, but the source says that issue should not block discharge of the property itself.

What to do before you list or sign a contract

Before the closing date, gather the deed, mortgage statements, recent payoffs, title report, listing agreement, and comparable sales. If the property is underwater, ask whether the file supports a discharge request under IRM 5.12.10 and whether the closing is better framed as a short sale or a no-equity sale. If there is a proposed escrow structure, keep the records clear enough to show exactly who gets paid and why.

For Pacoima taxpayers, the most useful next step is a case review built around the actual sale documents rather than the account balance alone. That helps identify whether the IRS interest is truly valueless in the property, whether a discharge request is needed, and whether any proceeds are being redirected in a way that changes the analysis. It does not guarantee approval, but it can prevent a closing from stalling over avoidable paperwork.

Questions about Selling property when proceeds will not cover the debt

Does a low sale price automatically remove the federal tax lien?

No. A low price does not by itself remove the lien or forgive the debt. The IRS still looks at how the sale is structured, whether senior liens consume the equity, and whether a discharge is appropriate for the specific property.

If the IRS agrees to a discharge, is the tax debt paid off?

No. A discharge removes the lien from the property being sold, but the underlying tax debt can remain unpaid. Payment in full is the clearest way to get rid of a federal tax lien, and a release is separate from a discharge.

Can the county recorder approve my federal lien relief request?

No. County recorder offices record deeds and lien documents, but they do not decide IRS discharge, subordination, or withdrawal requests. Those requests go through IRS collection procedures and, for complex lien issues, the Collection Advisory process.
