In Hurst, TX, selling property when proceeds will not cover the debt usually turns on the IRS’s interest in that specific parcel, not on the full unpaid balance. A recorded Notice of Federal Tax Lien is a public claim, but it is not the same as a levy. If the closing will not produce equity for the government, the practical question is whether the property can be discharged so the sale can close without pretending the tax debt disappeared.

Start with the property interest, not the total balance

The key distinction is whether the government still has value in the property being sold. Under IRM 5.12.10, Advisory may consider the property’s forced sale value when market conditions are weak and a discharge would help the taxpayer complete the transaction. That is not automatic. The IRS decides whether to use forced sale value, and any disagreement should be documented with comparable sales, current market conditions, or other evidence that supports the valuation.

If the sale is a short sale, IRM 5.12.10 treats it under IRC 6325(b)(2)(B). In that structure, the senior lien holder agrees to take less than it is owed, and the federal tax lien may have no remaining value in the property. That does not erase the liability. It only addresses whether the lien needs to be discharged from the property so the transfer can happen.

Use the closing file to show why the lien should not block the sale

The strongest file is a closing package that explains the exact distribution of sale proceeds. Include the purchase contract, payoff statements, settlement statement, title report, and any written agreement showing how senior liens and closing costs will be paid. If the lender is allowing expenses or junior claims to be paid out of its share, that does not automatically create equity for the IRS. IRM 5.12.10 says the government generally has no authority to demand money carved out of a senior lien holder’s own priority interest when the government’s interest in the property remains valueless.

If the property has no equity after senior claims, the issue is usually discharge of the real estate, not a withdrawal of the public notice and not a release of the debt. Those are different remedies. A discharge removes the lien from specific property; a withdrawal removes the public Notice of Federal Tax Lien; and a release is tied to satisfaction of the debt. None of those should be described as wiping out an unpaid balance unless the debt has actually been paid or otherwise resolved.

Check whether proceeds belong to the taxpayer or to the senior lien holder

A practical decision point is whether any cash from the closing is going to the taxpayer after the senior lien holder is paid. IRM 5.12.10 explains that if the senior lien holder gives the taxpayer an incentive payment from its own equitable interest, that payment is an asset that may be levied. That question is separate from discharge. The discharge issue is whether the sale can close free of the federal tax lien; the levy issue is whether the IRS can pursue a payment the taxpayer receives at closing.

For that reason, a seller should not assume that a no-equity closing prevents all IRS collection activity. It may solve the title problem for the property while leaving other collection questions open. If the sale proceeds or an incentive payment will be held in escrow, the file should make clear who owns the funds, what lien interests attach to them, and whether any party is asking for a substituted-proceeds arrangement under IRM 5.12.10.

A practical next step before the contract deadline

Before the closing date, gather the recorded lien, payoff figures, title commitment, settlement statement draft, and any current market evidence that supports the valuation. If the facts show no equity for the government, ask for a discharge request review rather than assuming the title company can sort it out alone. Tarrant County Clerk records may help verify what has been recorded against the property, but the clerk does not decide federal tax collection relief.

A clear next step is a case review with the IRS notice and closing documents in hand. That review can help determine whether the file supports a discharge, whether the sale should be treated as a short sale, and whether any closing proceeds require separate levy analysis. A conference can clarify the right procedure before everyone signs the wrong paperwork.

Questions about Selling property when proceeds will not cover the debt

Does a low sales price automatically remove the federal tax lien from the property?

No. A low price may support a discharge request, but the IRS still has to decide whether the lien has any value in that property and whether the facts fit the discharge rules in IRM 5.12.10.

If the lender agrees to accept less than it is owed, does that mean the IRS debt is settled too?

No. A short sale only affects the lender’s claim and the property transfer. The federal tax debt can remain unpaid unless it is separately resolved through payment, release, or another IRS action.

Should I ask for a withdrawal instead of a discharge when I sell underwater property?

Usually no. A withdrawal removes the public Notice of Federal Tax Lien, but it does not remove the debt. A discharge is the remedy that addresses specific property so a sale can close while the liability remains in place.
