In Saugus, CA, a refinance can still be possible after a Notice of Federal Tax Lien is filed, but the right IRS request depends on what the lender needs and what property is actually involved. The notice is not the same thing as a levy, and it does not erase the tax debt. Under IRM 5.12.10, the practical question is whether the IRS should subordinate, discharge, or confirm the lien does not attach to the property at all.

Start with the property and the recorded notice

A refinance review should begin with the title record and the specific parcel or account the lender wants to use. The Notice of Federal Tax Lien is a public filing that alerts creditors that the government has a legal claim against the taxpayer’s property. It can attach to current and later-acquired property, but the address shown on the notice is only a mailing reference; it does not by itself prove the lien reaches that exact property.

If the refinance involves a home in the Valencia or Santa Clarita area, the Los Angeles County Registrar-Recorder/County Clerk is the local public-records office that records instruments affecting title. That office does not approve federal lien relief, but it can help confirm what is already on record. This is useful when the lender asks whether the lien is attached to the property being refinanced or whether a separate property-interest issue exists.

Match the IRS procedure to the lender’s request

Subordination is usually the refinancing tool lenders ask about when they want to move ahead of the IRS without removing the lien. IRM 5.12.10 explains that subordination does not remove the lien; it allows another creditor to take a higher position for part or all of the property. The IRS may approve it if doing so is in the government’s best interest, often when the refinance helps collect the debt or improves the government’s position.

Discharge is different. A discharge removes the lien from specific property, which can matter if one parcel is being sold or refinanced and the government’s interest can be protected elsewhere. If the issue is not the debt itself but a mistaken attachment to property the taxpayer never owned, a certificate of non-attachment may be the better question. Do not assume a recorded lien on your file means the lender needs the same IRS certificate in every case.

Gather the records before you apply

A refinance packet should be built from documents, not estimates. Helpful records typically include the title report, the lender’s payoff or closing instructions, a deed or other proof of ownership, the Notice of Federal Tax Lien, and the most recent IRS balance information. If the request is for subordination, the lender’s terms matter because the IRS looks at the collection impact of the proposal, not just the existence of a loan.

If the request is for discharge, the file should show why the property can be removed from the lien without harming the government’s interest. If the issue is non-attachment, the records should show that the taxpayer did not have a legal interest in the property when the lien arose, or never had one at all. As IRM 5.12.10 notes, the form used to address these issues is not a one-size-fits-all release.

Take one practical next step

Before the lender locks the loan file, compare the title report, ownership records, and the lender’s exact request. If the question is routine, the Centralized Lien Operation may handle basic verification, payoff, or release issues. More complex requests, including subordination or discharge, usually belong with Collection Advisory. A taxpayer can also use the IRS local office locator or the Taxpayer Advocate locator if a notice problem is not moving normally.

Hypothetically, if a lender will only close after the IRS agrees to stand behind the new mortgage, the issue is subordination, not release. If the property itself is being removed from the transaction, discharge may be the right question. If the notice appears to follow a property the taxpayer never owned, non-attachment is the focus. The fastest path is to identify the transaction first, then ask for the correct certificate.

Questions about Refinancing while a Notice of Federal Tax Lien is filed

Does refinancing automatically remove a Notice of Federal Tax Lien?

No. A refinance may be possible, but the lien usually remains unless the IRS approves a separate action. Subordination, discharge, withdrawal, release, and satisfaction are different outcomes, and none should be assumed from the others.

Is the recorded notice the same as a levy?

No. A lien is a legal claim that secures the debt; a levy actually takes property to collect it. A refinance issue usually concerns how the lien affects title, not whether the IRS has seized the property.

What if the lender says the lien is on the wrong property?

Then the file should focus on ownership and attachment, not payoff alone. If the taxpayer never had a legal interest in that property, a non-attachment request may be appropriate. The title report and deed history are key records to review.
