In Saugus, CA, a housing expense above the IRS collection standard is not automatically accepted, but it is not automatically disallowed either. The key issue is whether your actual housing cost is necessary, properly substantiated, and tied to your true ability to pay. Under IRM 5.15.1, the IRS starts with the local housing standard and may deviate when rigid use of the standard would create economic hardship.

Start with the standard, then prove why your facts differ

The Collection Financial Standards are only the starting point. IRM 5.15.1 explains that the IRS uses national and local standards to keep expense allowances consistent, including housing and utilities. When your actual housing cost is higher, the question becomes whether your facts justify a departure from the standard.

That means the IRS will look for more than a rent or mortgage figure on its own. It will want to know whether the cost is necessary, whether the household structure explains the amount, and whether the claimed expense is really your share. If you live with a non-liable person, the IRS may review shared household income and expenses to determine your allowable portion, but it generally does not count the non-liable person’s income against you unless a community property rule applies.

Use records that connect the housing cost to your household reality

The most useful records are the ones that show the expense is real, recurring, and required. A lease, mortgage statement, rent ledger, utility bills, proof of payment, and a clear household budget can help show the amount you actually pay. If part of the home is shared, you should be ready to explain how the costs are divided and why your share is the correct share.

If you rent a room or apartment from the non-liable owner, IRM 5.15.1 says a rental agreement or signed statement from the owner can support the taxpayer’s reported arrangement without requiring the owner’s private financial details. That can matter when you are trying to show that the housing cost is not inflated or artificially shifted to avoid collection.

Show the IRS how the housing cost affects payment potential

The collection question is not whether housing is expensive in the abstract. It is whether your actual housing expense leaves you with money to pay the tax debt. The IRS reviews income, necessary expenses, and available payment potential. If your housing cost exceeds the standard, you need to explain what happens if the IRS forces the standard instead of your actual amount. For example, a hypothetical taxpayer might show that moving to a lower-cost home would require an immediate disruption, moving costs, or a new lease that is not realistically available.

Topic 201 confirms that the IRS may ask for a Collection Information Statement, such as Form 433-A, Form 433-B, or Form 433-F, along with proof of assets, income, and expenses. The practical goal is not to argue that a higher housing payment feels fair. It is to show, with documents, why the standard does not accurately reflect the taxpayer’s current ability to pay.

Know the limits and the next procedural step

A higher housing expense does not guarantee a reduced payment, currently not collectible status, or an installment agreement. The IRS can still decide that part of the expense is not necessary or that your overall finances allow some payment. Also, a delay in collection does not erase the debt, and penalties and interest generally continue to accrue until the balance is paid in full.

If the IRS and taxpayer disagree about an economic hardship determination, IRM 5.15.1 says the matter should be referred to the Taxpayer Advocate Service. In Saugus and the broader Los Angeles County area, the practical next step is to assemble a focused packet: the IRS notice, the completed financial statement, housing records, and a short written explanation of why the standard does not fit your household. If you are still unsure how the IRS will treat the numbers, request a case review or IRS notice conference before you send only partial records.

Questions about Housing expenses exceed a collection standard

Does paying above the IRS housing standard mean I qualify for relief?

No. The IRS may consider a higher housing cost if the facts support it, but you still must substantiate the expense and show that it is necessary or that using the standard would create economic hardship.

Should I send the IRS my spouse or roommate’s full financial details?

Not automatically. If the household includes a non-liable person, the IRS may review shared income and expenses to determine your portion, but the documents needed depend on the facts. A lease, signed statement, or shared-expense proof may be enough in some cases.

Will a currently not collectible decision erase my tax debt?

No. Topic 201 explains that currently not collectible status only delays collection because of hardship. The debt remains, and interest and penalties generally continue until paid in full.
