In Rockwall, TX, when a revenue officer asks for records through a representative, the first issue is not the paperwork itself. It is whether the representative is properly authorized, what the authorization covers, and whether the IRS should be communicating with the representative instead of the taxpayer. IRM 5.1.23 supports the right to retain representation, and the Taxpayer Bill of Rights protects confidentiality and fair treatment.

Start with the authorization, not the document list

Under IRM 5.1.23, taxpayers may choose self-representation or appoint an authorized representative. For collection matters, the IRS generally expects valid written authority before discussing the account with someone else. A Form 2848 can authorize practice before the IRS; a third-party authorization can allow access to confidential information without creating full representation rights.

The practical question is whether the request matches the authority on file. A representative may be valid for collection, but still not authorized for every tax period or every tax matter. The IRS also uses CAF records to track the taxpayer relationship, so the key record review is whether the authorization is current and whether the tax matters line is complete. If the scope is unclear, the safer response is to verify the authorization before sending broad records.

Compare the three procedures: provide, clarify, or limit contact

One path is simple document production through the representative. That works best when the authorization is current, the requested records are clearly tied to the covered tax matters, and the taxpayer has already chosen that channel. Another path is to clarify the request. If the revenue officer’s request is too broad, the representative can ask for a narrower list tied to the account issue rather than sending unrelated bank statements, payroll records, or business files.

A third path is to limit direct contact. IRC 6304 generally restricts collection communication with a represented taxpayer unless prior consent exists. That means the IRS should not bypass the representative just because it is more convenient to speak with the taxpayer. IRM 5.1.23 explains that bypassing a representative is a separate process, and it is not the same as a proper direct contact made with documented taxpayer consent.

Protect privacy while avoiding an unnecessary records gap

The Taxpayer Bill of Rights gives taxpayers the right to confidentiality and to retain representation. Those rights work together: the IRS can request information needed to work the case, but the taxpayer does not lose privacy protections by naming a representative. At the same time, privacy rights do not mean the taxpayer can ignore a valid request entirely. The better approach is to decide which records are actually relevant to the collection issue and provide only that set through the proper channel.

For example, a hypothetical taxpayer who authorized a representative only for a single employment tax quarter should not assume that a request for older personal financial records is covered. The issue is not refusal; it is scope. Reviewing the authorization, the IRS request, and the account type together helps avoid over-disclosure and under-response.

Use the request to choose the next practical step

If the representative already has valid authority, gather the requested records, label them by period and account type, and keep a copy of everything sent. If the authorization is outdated or incomplete, update it before transmitting sensitive information. If the IRS is asking for something outside the covered matters, the representative should ask for a corrected request or a narrower explanation of what is needed.

If the taxpayer believes the communication handling is improper, the next step is usually not a separate misconduct complaint by itself. A complaint may document conduct concerns, but it does not replace an appeal or automatically suspend collection. For unresolved representation questions, IRM 5.1.23 is the most relevant procedural guide, and a taxpayer may also seek help from the Taxpayer Advocate Service if the case is stuck in normal channels. A local case review can help determine whether to respond through the representative, revise the authorization, or challenge the scope of the request.

Questions about A revenue officer asks for records through a representative

Can the IRS ask my representative for records instead of me?

Yes, if the representative has valid authority for the tax matter. The IRS must still respect the scope of that authority and the taxpayer’s confidentiality rights.

Does a Form 2848 let the representative handle every IRS issue?

No. The authorization must cover the correct tax matters and periods. A representative’s authority can be broad or narrow, so the IRS request should be matched to the form on file.

If the IRS contacts me directly, does that mean my representative is ignored?

Not necessarily. But IRC 6304 and IRM 5.1.23 limit collection communication with represented taxpayers unless the proper conditions for direct contact are met and documented.
