In Allen, TX, a bank levy can still move forward even while a payment request is pending. The key issue is whether the IRS actually granted relief or whether the bank is still inside the 21-day holding period described in IRM 5.11.4. A filed request alone is not the same as an approved agreement, and the bank may still be required to freeze and later surrender funds unless the levy is released for another reason.

What the 21-day hold changes

Under IRM 5.11.4, when the IRS serves a levy on a bank or similar financial institution, the bank generally must wait 21 calendar days before sending the money to the IRS, subject to limited exceptions. That waiting period matters because the levy may be released during the hold, the amount owed may change, or a pending collection action may be resolved before the bank forwards the funds.

This is why the first question is not simply whether you asked for a payment plan, but whether the IRS has approved something that changes the levy status. The IRS website also notes that funds in the account are held and, after 21 days, sent to the IRS if the levy remains in place. If the levy was issued while a Collection Due Process hearing was pending, IRM 5.11.2 says it must be released because the levy violates the law.

When a payment request can affect the levy

IRM 5.11.2.3.1.4 says a levy must be released if the IRS entered into an installment agreement with the taxpayer, unless the agreement allows the levy to continue. That distinction matters. An application, proposal, or pending request does not by itself create the same legal effect as an approved agreement.

So the decision point is narrow: did the IRS actually accept the arrangement, or is the request still under review? If the agreement is granted, the levy may need to be released unless the agreement specifically says otherwise. If the request is still pending, the levy may remain active during the bank’s hold period. Do not assume that submitting a request suspends collection or freezes the IRS process automatically.

Records that help prove the right next step

To evaluate the situation, gather the levy notice, any installment agreement submission or confirmation, IRS letters, proof of when the bank received the levy, and recent account statements. If the funds in the account came from a direct deposit paycheck, remember that once income is deposited into the bank, the wage levy exemption no longer applies in the account itself under IRM 5.11.4.

If the account includes money that belongs partly or entirely to someone else, ownership evidence matters. IRM 5.11.4 explains that a levy can attach to funds where the taxpayer has an unrestricted right to withdraw money, even when another person contributed the deposits. A third party may need to pursue a wrongful levy claim under the procedures referenced in the IRM if the money is not actually the taxpayer’s. That is a separate issue from whether your payment request is pending.

Practical next step before the hold expires

Contact the IRS quickly and ask two questions: whether the payment request was granted, and whether the levy has been released or is still scheduled to be paid after the hold. If the bank is still within the 21-day window, timing may matter because the IRS can release the levy before the funds are sent. If the levy has already matured, the bank may have to surrender the funds, and a different remedy may be needed.

A hypothetical example: if a taxpayer files an installment agreement request on Monday and the bank receives a levy on Wednesday, the taxpayer should not assume the request blocks the levy. The useful follow-up is to confirm whether the IRS approved the agreement, whether the levy is being released, and whether the bank needs any written instructions before the 21-day period ends. If hardship or ownership issues are involved, raise those facts immediately with the IRS or seek a case review.

Questions about A bank levy arrives while a payment request is pending

Does filing a payment request stop a bank levy automatically?

No. A request that is still pending is not the same as an approved installment agreement. Under IRM 5.11.2.3.1.4, a levy is generally required to be released if an installment agreement is actually entered into, unless the agreement allows the levy to stay in place.

Why does the 21-day bank hold matter so much?

IRM 5.11.4 says the bank generally must wait 21 calendar days before turning over levied funds. That window can allow time for the levy to be released, the balance to change, or the IRS to finish reviewing a payment arrangement.

What if the money in the account belongs to someone else?

If a non-liable third party claims the funds, the issue may be a wrongful levy. Ownership proof matters, and the third party may need to use the claim procedures described in the IRM rather than rely on the taxpayer’s pending payment request.
