In Paris, TX, the right appeal path usually turns on the notice you received and whether you need to preserve a response deadline. A Collection Due Process request can protect broader review rights after the proper lien or levy notice, while the Collection Appeals Program can be faster for certain collection actions. The key is to identify the notice first, then file the correct request before the clock runs.

Under IRM 5.1.9, Collection Due Process rights arise from the written notice the IRS must provide under IRC 6320 and IRC 6330. A Notice of Federal Tax Lien filing or a final notice of intent to levy can open the CDP window. By contrast, CAP is used for specific collection actions and is often raised earlier in the case process.
If you are in Paris and the notice is only a warning or preliminary contact, do not assume you already have CDP rights. Save the envelope, the notice, and the date you received it. Those records matter because the filing deadline is tied to the actual notice path, not just to the fact that the IRS is collecting.
When CAP Can Be the Better Short-Term Move
CAP may be available when an installment agreement is rejected, modified, proposed to be modified, or about to be terminated, and when the taxpayer disagrees with a levy, seizure, or NFTL filing. IRS guidance in IRM 5.1.9 says collection personnel should advise taxpayers of CAP rights in those situations. CAP can provide an expedited review of a specific collection action.
That speed comes with a limit: CAP is not the same as a full CDP hearing. If the taxpayer needs the broader hearing framework, potential judicial review, or a chance to address collection alternatives in a more formal setting, CDP may matter more. A taxpayer can request both on the same event in some cases, but an issue decided in a meaningful CAP appeal may not be available again in CDP on the same factual basis unless new information is presented. Appeals decides that question.
What to Gather Before You File
To preserve a CDP deadline, use Form 12153 when the notice gives you that right. If the issue is CAP, use Form 9423, Collection Appeal Request. Either way, include enough facts to show which action you are challenging and why. If you want Appeals to consider a collection alternative, financial records often matter more than a general objection.
For a levy or proposed levy, a current financial statement may be needed, along with recent pay stubs, bank statements, business income records, or proof of essential expenses. If the concern is a lien filing, keep the filed notice and any proof that the filing affected property or credit. In Lamar County, taxpayers sometimes also need local ownership or recording records, but county clerks record documents; they do not decide IRS collection appeals.
Direct Representation and the Trust Phase
Allen Lenth, EA-MBA, can help organize the record, narrow the issue, and communicate with the IRS without losing the taxpayer’s deadline. That matters because a timely, processable filing is better than a later, more complete filing that misses the deadline. Representation also helps separate the appeal issue from unrelated collection history.
A practical next step is to read the notice closely, calendar the response date, and prepare the appeal with the right form and supporting records. If you are uncertain whether your facts fit CAP, CDP, or both, request a case review before the deadline expires. That review can help you decide what to file, what to attach, and what arguments to preserve for Appeals.
Questions about Collection Appeals Program versus Collection Due Process
Does filing CAP stop IRS collection automatically?
Not automatically. CAP is an appeal process, but it does not guarantee that collection action will pause. The effect depends on the action involved and the stage of the case. A taxpayer should not assume that representation alone stops enforcement.
Can I request both CAP and CDP for the same IRS action?
Sometimes, yes. IRS guidance says a taxpayer may request both on the same event, such as a proposed levy. But an issue resolved in CAP may not be available again in CDP on the same facts unless new information is presented, and Appeals decides that question.
Which form should I use in Paris, TX?
Use Form 12153 for a Collection Due Process or equivalent hearing request when the notice gives that right. Use Form 9423 for a Collection Appeals Program request. The right form depends on the notice and the collection action, so the notice itself should be checked first.

General educational guidance. Relief and collection protections depend on the actual notices, account history, financial evidence, and applicable law. A consultation does not itself stop enforcement or preserve an appeal deadline.
