In Pampa, TX, the safest move is usually to preserve the Collection Due Process deadline first, even if you do not yet have an affordable proposal ready. Under IRM 5.1.9, a timely request can keep Appeals review available while you finish the financial work. The key is to file a processable request with enough detail to show why you disagree and what collection action you want reviewed.

Start with the notice type and the clock it created

The deadline depends on the notice you received. A levy notice and a lien filing notice do not use the same timing rules, and the IRS treats them differently under IRM 5.1.9. For a levy notice, the written request is generally due within 30 days after the notice period begins. For an NFTL hearing request, the timing runs from the filing rules tied to Letter 3172 and its “must file by” date.

Do not assume that asking for help, calling the IRS, or gathering paperwork pauses the clock. The notice controls the deadline, not the fact that you are still trying to build a payment option. Keep the envelope, the notice itself, and proof of when you received or mailed your response. If the notice was filed or mailed under unusual circumstances, those records may matter later.

File enough to preserve review before the proposal is finished

If you do not yet have an affordable installment proposal, the request can still be worthwhile if it is otherwise processable. IRM 5.1.9 says the request should state the reason you disagree, include the taxpayer or authorized representative signature, and identify the periods involved. If you received a lien notice and a levy notice covering different periods, Appeals may consolidate the requests when appropriate.

For a collection-alternative case, the IRS FAQs explain that Appeals will need financial information such as Form 433-A for individuals or Form 433-B for businesses, as needed. That does not mean you must wait until every schedule is perfect before you protect the deadline. It does mean you should send the request first if timing is at risk, then complete the financial package promptly. A hypothetical example: if a taxpayer can show the notice was improper but cannot yet support an offer or payment plan, the request can still preserve the right to discuss alternatives later.

Know the difference between CDP, EH, and other routes

If the request is late, it may be treated as a request for an Equivalent Hearing, but an EH does not provide judicial review. IRM 5.1.9 also says that if the deadline has expired, the request should be sent to Appeals for a separate timeliness determination. If that fails, the IRS may point the taxpayer to other paths such as CAP or TAS assistance, depending on the facts.

This is why the first decision is often not about the best payment plan, but about the right procedural lane. A timely CDP request preserves more options than a late request. However, a timely request does not guarantee levy suspension forever, and it does not guarantee that Appeals will accept the collection alternative you eventually propose. It simply keeps the dispute in the proper review track while you finish the record.

Use representation to organize records and communicate cleanly

Allen Lenth, EA-MBA, Enrolled Agent representation is most useful here when it helps you make one clean record instead of several scattered ones. That means collecting the notice, proof of mailing, recent pay records, bank statements, expense records, and any documentation showing why the proposed payment is not affordable yet. If the taxpayer wants the issue handled through one point of contact, a properly authorized representative can help keep communication consistent and reduce missed follow-up requests.

For taxpayers in Pampa and Gray County, public records may matter if a lien filing needs to be confirmed, but the county clerk records documents; the clerk does not approve federal collection relief. The practical next step is to protect the deadline now, then finish the financial statement and any supporting explanation for Appeals. If the timing is uncertain, compare the notice date with the rules in IRM 5.1.9 before you choose whether to request a CDP hearing, an EH, or another procedural remedy.

Questions about A hearing request without an affordable proposal yet

Do I need a completed payment proposal before I file Form 12153?

No. If the deadline is close, filing a processable request can preserve review rights while you finish the proposal. The financial package can follow, but the request itself should identify the issue and be signed.

What records should I gather after filing the hearing request?

Keep the notice, proof of the filing date, income records, bank statements, expense documentation, and any letters showing why you disagree. If you are asking for a collection alternative, IRS guidance says financial statements may be needed for Appeals review.

Is a late request still worth sending?

Sometimes. IRM 5.1.9 says late requests may be sent to Appeals for a timeliness determination and may be treated as Equivalent Hearing requests. That route is not the same as a timely CDP hearing, and it does not provide judicial review.
