In Rowlett, TX, refinancing while a Notice of Federal Tax Lien is filed starts with the property, not the headline notice. A filed NFTL is public notice that the IRS has a claim against property the taxpayer owns or once owned, but it is not the same as a levy and it does not erase the debt. Under IRM 5.12.10, the practical question is which IRS certificate fits the lender’s closing requirement.

First identify what the lender is asking for

A refinance lender usually wants one of three things: confirmation that the lien never attached to the property, a discharge of that specific property, or subordination so the lender can move ahead of the IRS for the new loan. Those are different remedies with different records and different consequences.

If the property is in Dallas County, the county clerk records the public documents, but the clerk does not decide whether the IRS will approve lien relief. Recording office information can help you confirm what is already in the public record; it does not resolve the federal tax issue.

One important distinction from IRM 5.12.10 is that the address shown on the NFTL is only a mailing address. It does not by itself prove the lien reaches that property. The key question is whether the taxpayer actually has, or had when the lien arose, an interest in the home or other collateral being refinanced.

Choose the IRS procedure that matches the transaction

If the lender is simply replacing debt and wants a cleaner lien position, subordination may be the most relevant request. Subordination under IRC 6325(d) does not remove the lien. It allows another creditor to move ahead of the federal tax lien with respect to the covered property, and the IRS is not required to grant it unless it is in the best interest of the government.

If part of the property is being sold or stripped out of the refinance, discharge may fit better. A discharge removes the lien from specific property, but it does not make the underlying tax debt disappear. That distinction matters because a closing can proceed on one parcel or one asset while the tax liability remains unpaid.

If the taxpayer believes the property was never subject to the lien at all, the issue is not subordination. It is proof of non-attachment. IRM 5.12.10 notes that a certificate of non-attachment may be available when the taxpayer does not have, and never had, a legal interest in the property at that address.

The records that make the review workable

A practical refinance packet usually includes the lender’s payoff or closing conditions, the deed or other ownership record, any mortgage or deed of trust, and the IRS lien paperwork itself. If the transaction involves a title company, its title commitment can help show exactly what must be cleared before closing.

For a subordination request, the IRS looks at whether the proposed loan or refinancing will improve collection or otherwise support the government’s interest. Under IRM 5.12.10, Advisory staff may consider the taxpayer’s proposal to pay the balance of the tax liability and the collection impact of the requested action. That means the loan structure, not just the borrower’s explanation, matters.

A hypothetical example: if a Rowlett homeowner refinances to replace an older loan with a new mortgage secured by the same house, the lender may ask for subordination so the refinance can close. The taxpayer would then need to show why the new loan serves the government’s interest and provide the closing documents that describe the exact property and lien position.

A practical next step before the closing date

Do not assume the filed NFTL blocks every refinance. Instead, match the lender’s ask to the correct IRS remedy and gather the records that prove who owns the property, what debt is being replaced, and whether any part of the property should be removed from the lien or shown never to have been attached.

If the issue is straightforward, the Centralized Lien Operation can handle basic lien questions such as verification or payoff information, while more complex matters such as subordination or discharge generally go through Collection Advisory. The IRS also distinguishes between releasing a lien and withdrawing the public notice; those are separate outcomes and neither one should be treated as automatically erasing unpaid tax debt.

When the facts are unclear, a short case review before the lender’s deadline can prevent a closing delay. That review should focus on the recorded property interest, the lender’s requested certificate, and whether the IRS remedy is subordination, discharge, non-attachment, or something else.

Questions about Refinancing while a Notice of Federal Tax Lien is filed

Does a filed NFTL mean I cannot refinance at all?

No. A refinance may still be possible, but the lender will usually need the IRS issue addressed through subordination, discharge, or proof that the lien never attached to the property.

Will paying off my new mortgage remove the tax debt?

No. A refinance loan can change the lien position on the property, but it does not by itself satisfy the tax liability. Only payment or another IRS resolution changes the debt itself.

Should I ask for withdrawal instead of subordination?

Not if the lender needs the property lien addressed for closing. Withdrawal removes the public NFTL notice, but it is different from discharge and subordination, and it does not mean the debt is gone.
