In Tucson, AZ, an IRS notice sent to a prior address does not automatically erase your deadline, but it does change what you should verify first. The key issue is whether the IRS used your last known address and how you can prove when the notice was issued, received, or forwarded. That record check comes before deciding whether to request a CDP hearing, ask for a copy, or challenge timeliness.

First determine which notice started the clock

Not every IRS letter creates the same response right. A Notice of Intent to Levy and Notice of Your Right to a Hearing begins the 30-day period for a Collection Due Process request under IRC 6330, while a Letter 3172 relates to lien filing rights under IRC 6320. IRS FAQs explain that a lien filing notice and a levy notice each trigger different procedures, and the remedy you choose depends on which one was sent.

If the notice was mailed to an old address, check whether that was still your last known address at the time. IRM 5.1.9 says the IRS may send Letter 3172 by certified or registered mail to the last known address, and the IRS also documents how a notice was sent or delivered. For a joint liability, each spouse should receive a separately addressed notice, so do not assume one envelope covers both people.

Compare the three practical paths

One path is to request a duplicate of the notice and then act on the original deadline. IRM 5.1.9 says a taxpayer may request a copy of Letter 3172 from the Automated Lien System, and a copy of Letter 1058 from the case file or Integrated Collection System. That copy helps confirm the exact notice, the mailing address, and any fax number or office listed for response.

A second path is to file the hearing request in the manner the notice allows. The IRS says Form 12153 is the usual request form for CDP review, and timeliness is generally measured by the postmark, fax date, electronic submission date, or hand-delivery date, depending on how you submit it. If the notice lists more than one mailing address, the IRS says a request mailed to an address shown on the notice can still be timely if it was postmarked on time.

A third path is to prove the notice was sent to the wrong office or the wrong address. IRM 5.1.9 explains that if the notice does not identify the office that sent it, and you mailed the request to the wrong office, timeliness may still be judged by the postmark or fax date rather than when the IRS actually opened it. That matters when the paper trail shows you acted within the period, even if the IRS routed the request internally later.

What records matter most right now

Focus on records that show both address history and mailing timing. Useful items include a copy of the notice, USPS tracking or forwarding records, a lease or utility record showing when you moved, an IRS transcript showing the account address, and the envelope if you still have it. If the envelope is missing or the postmark is unclear, the IRS manual allows a reasonable delivery-time estimate based on the mail origin and receiving office.

If you already sent a hearing request elsewhere, do not assume the IRS will find it on its own. The manual says the IRS may check AMS, ICS, or IDRS when a taxpayer says the request went to another office, but you should also be ready to provide your own copy. A hypothetical example: if a taxpayer mailed Form 12153 to the return address on the notice instead of the separate hearing address, the postmark may still preserve timeliness if the notice itself listed that address for mailing. The exact result depends on the document in hand, not on memory.

Take the next step before the deadline slips

If you are still within the response period, send the hearing request immediately to the address or fax number shown on the notice, and keep proof of transmission. If you are uncertain whether the deadline was preserved, request a case review and bring the notice, envelope, and address-change records to the discussion. That lets you compare the possible procedures before the IRS treats the account as unchallenged.

For Tucson taxpayers, the practical goal is not to guess which IRS office should have received the paper. It is to preserve the deadline with the best evidence available, then decide whether the issue is a CDP hearing, a duplicate notice, or a proof-of-timely-mailing problem. A misplaced notice can be serious, but the response should be based on the document trail, not on the old address alone.

Questions about An IRS notice sent to a prior address

If the IRS sent the notice to my old address, is the deadline automatically invalid?

No. The more important questions are whether the IRS used your last known address, what kind of notice it was, and whether you can prove timely mailing or receipt. A wrong address can matter, but it does not automatically eliminate the deadline.

Should I ask for a copy of the notice before filing Form 12153?

If you do not have the full notice, yes. A copy helps confirm the exact notice type, the response address, the fax number, and the deadline-triggering language. IRM 5.1.9 allows duplicates of Letter 3172 and Letter 1058 to be provided from the IRS file systems.

Does mailing the hearing request to the wrong IRS office always make it late?

Not always. The IRS manual says timeliness can still be measured by the postmark, fax date, or other proof of timely submission, depending on where the request was sent and what the notice showed. The documents matter more than the office label alone.
