If you received a lien hearing notice in Val Verde during an open IRS collection case, the first move is to protect the Collection Due Process deadline before you argue the tax itself. A timely written request can preserve Appeals review under IRC 6320; a late or incomplete request can narrow your choices and move the case into a different procedural track.

Identify which notice started the clock

The right response depends on the notice, not just the word lien. A Notice of Federal Tax Lien filing notice starts a different timing rule than a levy notice, and the IRS explains that the lien notice gives a 30-day period that begins after the five-business-day filing window. IRM 5.1.9.3.2.1 is the key section for timing.

If you received Letter 3172, use the “must file by” date on that notice rather than guessing from memory. The IRS uses an estimated filing date because the lien is recorded by the local recording office, not filed directly by the IRS. That distinction matters when you are trying to show that your request was timely.

Use records that prove timeliness

The strongest record set is simple: the notice itself, the envelope if you have it, a copy of what you mailed or faxed, and proof of delivery. If you sent the request by mail to an address listed on the CDP notice and it was postmarked timely, the postmark can control the request date when it is received timely. If you faxed it, keep the confirmation page.

If you are missing the notice, the IRS says a duplicate Letter 3172 can be obtained from the Automated Lien System and marked duplicate. If you already submitted a request but the IRS says it has no record, IRM 5.1.9 directs the IRS to check internal systems and ask you for a copy. That is why keeping your own dated copy is so important.

File the request so it stays processable

A usable CDP request should be sent or hand-delivered to an IRS office and address shown on the notice. The IRS also notes that, if available, electronic submission through the Document Upload Tool or Secure Messaging may be used through the revenue officer, and a fax number on the notice may also be used. The practical point is to use the route listed on the notice and keep evidence of delivery.

If your request is timely but missing information, the IRS may treat it as timely but not processable until you fix the defect within a reasonable time. That is why the safest approach is to include the notice copy, the tax periods involved, and a clear statement that you want a CDP hearing for the lien filing. If you want to exclude a period listed on the notice, say so expressly rather than leaving the IRS to guess.

Know the limit if the deadline has passed

If the response window has expired, you may still have an Equivalent Hearing option, but that is not the same as a timely CDP hearing. The IRS will send late requests to Appeals for a separate timeliness determination, and if Appeals agrees the request is late, your available choices may shift to CAP, retained jurisdiction, or TAS assistance depending on the facts. A late request does not automatically stop collection.

Also keep the collection tools distinct. A lien notice involves the public filing of a Notice of Federal Tax Lien; it is not the same as a levy, and a lien release, withdrawal, discharge, or debt satisfaction are separate outcomes. Even if you later obtain relief on the filing itself, that does not erase an unpaid debt by itself. For a Val Verde taxpayer, the next practical step is to assemble the notice, mailing proof, and account records before the deadline runs out and get a case review focused on timeliness, not just the balance due.

Questions about A lien hearing notice during a pending collection case

Does a lien hearing notice stop IRS collection by itself?

No. A timely CDP request preserves your right to Appeals review, but it does not guarantee that collection action stops or that the IRS will agree to suspend enforcement in every case.

What if I disagree with the lien but missed the filing deadline?

You may still have an Equivalent Hearing or other procedural options, depending on the notice and timing. The IRS will first determine whether the request is timely, so keep copies and ask for a timeliness review.

Should I include financial forms with the request?

If you want Appeals to consider collection alternatives, financial information can help. The IRS says Forms 433-A and/or 433-B may be needed, depending on whether you are an individual or business taxpayer.
