If you received a lien hearing notice in Thomasville during a pending IRS collection case, the first decision is not whether you agree with the tax. It is whether you can preserve the Collection Due Process deadline. Under IRC 6320 and IRM 5.1.9, a timely written request keeps your Appeals rights alive; a missed deadline can narrow your choices and change the next procedural step.

Identify the notice that started the clock

For a lien case, the important document is the Notice of Federal Tax Lien filing notice, commonly Letter 3172. The IRS uses that notice to tell you that a lien has been filed and that you may request a CDP hearing. The local recording office files the NFTL, but the IRS sends the notice and sets out the date you must use.

In the Thomasville area, county recording records may help confirm that a federal lien was filed, but they do not decide whether your IRS request is timely. The deadline comes from the IRS notice itself and the rules in IRM 5.1.9. If you cannot locate the notice, request a duplicate copy and keep the envelope, postmark, and any account transcript or case notes that show when the notice was issued.

Use records that prove timeliness

A strong response file is built around dates. Save the notice, the mailing envelope if you still have it, a postal receipt, fax confirmation, delivery tracking, or a copy of any electronic submission. IRM 5.1.9 explains that a written request sent to an IRS office named on the notice can be timely if it is properly mailed and received within the filing window.

If the notice lists a fax number, use that number. If it does not, the IRS says you may call the toll-free number on the notice or 1-800-829-1040 to get the correct fax number. You may also hand-deliver the request to a local taxpayer assistance center within the period stated on the notice. Keep copies of everything you send. If you later have to show timeliness, the record matters more than a verbal explanation.

File the request so the issue stays open

The request itself should identify the notice, the tax periods on the notice, and the relief you want. If you are only disputing some periods, you can exclude a specific period that is not in dispute. If the notice covers both a lien filing and a levy proposal, Appeals may consolidate the requests, but you should still respond to the notice you actually received.

Do not wait to assemble a perfect package if the deadline is close. A timely but incomplete request can sometimes be perfected later under IRM 5.1.9.3.2.3. That means you may still have a chance to add missing details after the initial filing. A hypothetical example: if a taxpayer mails Form 12153 on time but forgets to attach financial statements, the request may still preserve the hearing right while Appeals asks for more information. The key point is to file before the window closes.

Know the limit if the deadline has passed

A late request does not create the same CDP right as a timely one. The IRS materials say a late filing may be treated as an equivalent hearing request, and Appeals makes a separate timeliness determination. If that happens, your options may shift to other procedures such as the Collection Appeals Program or, in some situations, asking the Taxpayer Advocate Service for help with the process.

A late request also does not erase the lien, release the lien, or cancel the underlying tax debt. Those are separate issues. A withdrawal of the NFTL, a release of the tax lien, discharge of specific property, and satisfaction of the debt are different outcomes. For a collection case in Thomasville, the practical next step is to review the notice date, calendar the response period, and submit a written request to the exact IRS address or fax listed on the notice before the deadline expires.

Questions about A lien hearing notice during a pending collection case

Does filing a CDP request stop collection right away?

A timely CDP request can affect the timing of enforced collection, but it does not guarantee that all collection activity stops in every situation. Do not assume the notice is suspended just because you plan to appeal. File on time and review the notice instructions carefully.

What if I only disagree with part of the lien notice?

You can focus the request on the periods you are disputing and exclude a specific period that is not in dispute. That helps Appeals understand which tax periods you want reviewed without making the request broader than necessary.

Can I send the request to any IRS office in Georgia?

No. The IRS says the request should go to the office and address shown on the CDP notice, unless the notice gives a fax option or other submission method. Keep proof of where and when you sent it.
