In Roseville, CA, missing the Collection Due Process deadline does not always end the conversation with the IRS, but it does change the path. A late request may be treated as an equivalent hearing if you specifically ask for that treatment. The key decision is whether you can still preserve the timing facts, the notice date, and the reason you want Appeals to review the collection action.

Start with the notice date, not the collection balance

The first timeline question is which notice started your clock. Under IRM 5.1.9, a CDP levy hearing request is generally timely only if it is submitted within 30 days after the levy notice period begins, and a lien hearing request has its own timing rule tied to the filing of the NFTL and the five-business-day period that follows. A late filing may still qualify for an equivalent hearing, but only if it is specifically requested.

Do not assume the same deadline applies to every notice. A levy notice and a Notice of Federal Tax Lien filing are separate procedural events, and the timing rules are not identical. If you are trying to preserve rights after a missed deadline, the exact notice type and the date it was issued matter more than the amount shown on the account.

Decide whether the filing should be treated as late CDP or an equivalent hearing request

If the request was late, Appeals may still consider it as an equivalent hearing if you ask for that treatment. IRM 5.1.9 says a taxpayer who missed the CDP window can request an administrative hearing with Appeals, and Appeals generally follows the same procedures used for a timely hearing. The difference is important: Appeals issues a Decision Letter instead of a Notice of Determination, and there is no judicial review for an equivalent hearing.

If you did not mark the request as an equivalent hearing, the IRS can still notify you that the filing was late and advise you of the right to request one, unless the postmark is already outside the one-year period for requesting an equivalent hearing. In practice, the safest move is to state in writing that you want the late request considered as an equivalent hearing and identify the collection action you want reviewed.

Build the record around the reason for disagreement

The most useful supporting records are the ones that explain why you disagree with the collection action and why the request is late. IRM 5.1.9 says the request should include the reason you disagree, the taxpayer or representative signature, and the applicable periods. If you are challenging the IRS action, include the notice copy, a timeline of when it arrived, the envelope or electronic transmission record if you still have it, and any proof showing when you sent your response.

If you want collection alternatives considered, attach financial information that matches your request. The IRS FAQ says Form 12153 can be paired with financial statements such as Form 433-A or Form 433-B when you are asking Appeals to evaluate payment alternatives. That does not guarantee relief, but it helps Appeals see whether your request is really about the propriety of the collection action, the liability, or a workable way to resolve the account.

Know the limits of an equivalent hearing before you rely on it

An equivalent hearing is not the same as a timely CDP hearing. The official source states that CSEDs are not suspended during an equivalent hearing, and the taxpayer is not entitled to judicial review of the resulting Decision Letter. In other words, a late request may still give you a structured Appeals review, but it does not freeze collection the way some taxpayers expect.

Also, a late filing does not cure every problem. The IRS can disregard hearing requests that are frivolous or intended to delay or impede tax administration. And a missed deadline should not be confused with a collection lawsuit, a levy release, or a lien release. If the debt is still unpaid, the underlying balance remains unless another action resolves it. For a practical next step in Roseville, gather the notice, envelope or transmission proof, and a short written explanation of why you want the late request treated as an equivalent hearing, then prepare to discuss the case with Appeals or seek a case review.

Questions about Equivalent hearing after a missed CDP deadline

Does an equivalent hearing stop IRS collection action?

Not automatically. The official extract says CSEDs are not suspended during an equivalent hearing, and the taxpayer does not receive judicial review from the resulting Decision Letter. Do not assume the hearing itself pauses every enforcement step.

Can I ask for an equivalent hearing orally?

The source says a taxpayer can request an equivalent hearing orally or in writing if the CDP request is untimely, and the IRS can document the reason. Even so, a written record is usually safer because it helps preserve the timing facts and the issues you want reviewed.

What if I missed the deadline for both a levy notice and an NFTL notice?

You may still be able to request a hearing on one or both notices, but the timing rules differ. IRM 5.1.9 says Appeals should consolidate requests when both notices are involved, and if the hearing window has expired, the request may be handled as an equivalent hearing if one is still available.
