If you live in Belton, TX and the IRS sent a notice to a prior address, the first issue is not whether the notice was fair; it is whether you can still protect your response deadline. The IRS generally uses the taxpayer’s last known address for required collection notices, and the timing rules differ depending on whether the notice was a lien notice or a levy notice. A document-led review should start immediately with the notice itself, the envelope, and proof of when and where it was mailed or received.

Identify the notice before you decide what to do

A notice sent to an old address can be a serious problem, but the next step depends on which notice it was. Letter 3172 is the Notice of Federal Tax Lien Filing and Your Right to a Hearing under IRC 6320. Letter 1058, LT-11, or another Notice of Intent to Levy and Your Right to a Hearing is the pre-levy notice under IRC 6330. The IRS rules in IRM 5.1.9 say the notice is generally sent to the last known address, and the right to request a hearing begins from that notice date or receipt, depending on the program.

Preserve the deadline even if the mail went to the wrong place

For a levy notice, IRC 6330 generally gives you 30 days to request a Collection Due Process hearing. The IRS says the request can be mailed, faxed, electronically submitted when available, or hand-delivered to the proper IRS address on the notice. If the request is mailed to an address shown on the notice and is postmarked timely, timeliness is usually measured from that postmark, even if the IRS receives it later. If the notice did not list the right office and you sent the request to the wrong one, the postmark, meter mark, fax date, or hand-delivery date can still control.

Build the record before you argue the tax

A strong file for a Belton case should include the notice, the envelope if it was forwarded, USPS tracking or other delivery proof, a copy of any address-change request you filed with the IRS, and any IRS correspondence showing what address the agency used. IRM 5.1.9 also says the IRS should document how the notice was issued or delivered. If the matter is joint, each spouse should have been separately sent the required notice to that spouse’s last known address, so keep records for both names if needed.

Use direct representation to reduce avoidable mistakes

A case review with Allen Lenth, EA-MBA, focuses on whether the IRS notice was actually mailed correctly, what address the IRS had on file, and which submission method best preserves the deadline. That review is practical because it can determine whether you should send a hearing request, ask for a duplicate notice, or gather proof that the request was timely even though it was sent to the wrong office. A hypothetical example: if a taxpayer moved before the IRS mailed Letter 3172 and kept proof of a filed address update, that documentation may matter more than a later phone call.

Questions about An IRS notice sent to a prior address

Does a notice sent to my old address automatically make the IRS case invalid?

Not automatically. The key questions are whether the IRS used your last known address and whether you can still prove a timely response. The remedy depends on the notice type and the facts in the file.

Can I ask for a CDP hearing if I got the levy notice late?

Often yes, if the request is still within the required period or is otherwise timely under the mailing rules. The safer move is to send the hearing request quickly and keep proof of how and when you submitted it.

Should I wait to talk to the IRS before filing anything?

No. A phone call does not preserve the deadline by itself. File the hearing request or other required response first, then use the call to clarify address records, notice delivery, and the correct IRS office.
