In Castaic, CA, a short closing calendar makes the biggest mistake easy to make: assuming the recorded federal tax lien disappears when the home sells. It usually does not. The more important question is whether the IRS should issue a discharge for the specific property, whether the lien must be paid from closing proceeds, or whether the recorded notice simply stays in place while the tax debt remains unpaid.

Start with the lien record, not the closing date

A federal tax lien arises by operation of law when a tax is assessed and the taxpayer neglects or refuses to pay after demand. The Notice of Federal Tax Lien is the public filing that alerts third parties and is typically recorded with state or local recording offices. In Los Angeles County, the county recorder’s office records documents, but it does not decide whether the IRS should grant discharge, withdrawal, or other collection relief.

Because the NFTL is a notice, not the debt itself, a title report may show a recorded federal tax lien even though the property sale is moving quickly. IRM 5.12.10 explains the distinction between the statutory lien and the public notice. That distinction matters at closing because a seller, buyer, title company, and lender may each need different proof.

Use the closing file to decide what the IRS must do

The most consequential filing error is asking for the wrong remedy. If the home is being sold and the lien does not need to stay on that specific parcel, the relevant request may be a discharge of property under IRC 6325(b), not a release of the tax debt itself. A discharge removes the lien from specific property; it does not erase the underlying liability. A release is different again and occurs when the liability is satisfied or becomes unenforceable.

If the sale is a short sale or otherwise leaves no equity for the United States after the senior mortgage is paid, IRM 5.12.10 says the government’s interest in that property may be valueless. In that setting, the IRS may issue a no-equity discharge upon sufficient proof of closing and transfer. If the sale produces surplus proceeds, those proceeds may be part of the analysis and can change which action is appropriate. The closing statement, mortgage payoff figures, and title evidence are the records that answer that question.

Do not confuse discharge, withdrawal, and levy issues

A discharge does not remove the notice from the public record, and a withdrawal does not eliminate the tax debt. Withdrawal removes the public Notice of Federal Tax Lien; it does not mean the amount due vanishes. Release, discharge, and withdrawal are distinct outcomes, and a fast sale should not blur them together.

Also, a lien is not a levy. The lien secures the government’s interest; a levy actually takes property to pay the tax debt. If the closing produces funds payable to the taxpayer, that cash may raise levy questions separately from the discharge request. IRM 5.12.10 notes that the receipt or non-receipt of taxpayer funds can be addressed under levy procedures, while the discharge decision turns on the government’s interest in the real estate itself.

Practical next step before the signing table

Before closing, gather the recorded NFTL, the preliminary title report, the proposed settlement statement, payoff figures for every lien with priority ahead of the IRS, and any documents showing how sale proceeds will be distributed. If there is a short sale or the property has no equity for the federal lien, that evidence should be organized clearly. If the issue is complex, the IRS Collection Advisory Group is the right place for discharge, subordination, or withdrawal questions; routine payoff or release questions may go through Centralized Lien Operation.

If you need help reviewing the closing file before the calendar runs out, a focused case review can identify whether the IRS is being asked for the right action and whether the records support it. That review should not assume the lien is gone, the debt is paid, or the sale alone fixes the public record.

Questions about A home sale with a short closing calendar

Does a home sale automatically remove a federal tax lien?

No. A sale does not automatically remove the lien. The lien may remain on the tax account until the liability is satisfied or unenforceable, and a recorded NFTL may remain in the public record until the IRS takes the proper action.

What records matter most for a short-notice closing?

The most useful records are the preliminary title report, the recorded NFTL, mortgage payoff statements, and the proposed closing statement. Those documents show whether the IRS has any remaining interest in the property or only in surplus proceeds.

Is a county recorder the office that approves IRS lien relief?

No. The county recorder records documents. It does not decide whether the IRS should discharge, withdraw, subordinate, or release a federal tax lien.
