In St. Petersburg, FL, the biggest Form 2848 mistake is treating it like a blanket pass. It is only as broad as the tax periods, tax types, and actions you list. If the scope is too narrow, the IRS may be unable to speak freely with your representative or send notices properly; if it is too broad or incomplete, you can create disclosure problems instead of solving the case.

What Form 2848 actually does

Form 2848 authorizes an eligible individual to represent you before the IRS and to receive and inspect your confidential tax information. Under IRM 5.1.23, that includes communication with Collection when the representative is eligible to practice before the IRS. It does not, however, give authority to just anyone you trust. An unenrolled tax return preparer cannot represent you before Collection, and an Annual Filing Season Program participant has only limited rights.

The form also has a privacy function. The Taxpayer Bill of Rights protects your right to confidentiality and your right to retain representation. That means the IRS should disclose information only within the limits you authorize. In practical terms, the representative only helps with the periods and issues covered by the filing. A form that omits a liability period may leave the key notice outside the authorization.

The most common scope errors

The hardest error to fix is assuming one signed form covers every tax issue. IRM 5.1.23.4.1 says the IRS uses the Centralized Authorization File to send courtesy copies only when the proper box is checked, and no more than two representatives or designees can receive those copies. If the wrong periods are listed, your representative may never see the notice that matters most.

Another frequent problem is using the wrong form for the job. Form 8821 lets a designee inspect or receive confidential information, but it does not allow advocacy or representation. If you want someone to talk to the IRS on your behalf, challenge issues, or negotiate collection matters, Form 2848 is the relevant form. If you only want information access, Form 8821 may be the better fit. Mixing those roles can cause the IRS to return the paperwork or treat the submission as incomplete.

Records to review before you sign

Before filing, compare the IRS notice, account transcript, and the specific tax periods involved. If a levy notice, balance-due notice, or exam notice covers several modules, make sure the authorization covers all of them. IRM 5.1.23 also warns that the authorized representative must be allowed to receive taxpayer data on every module included in the communication. Otherwise, the IRS may hold back information to avoid an improper disclosure.

Check the signature rules carefully. The taxpayer must sign the power of attorney, and page two of Form 2848 needs an original taxpayer signature unless you are using the IRS online submission process that accepts electronic signature images or digitized images of handwritten signatures. If a practitioner submits a later Form 2848 for different periods, the IRS should see a new original signature, not just a photocopy of the old one. For joint accounts, each spouse generally needs a separate authorization.

A practical next step in St. Petersburg

If you are responding to an IRS notice, start by listing the exact issue you want handled: which tax type, which year or period, and which action you want your representative to take. Then verify that the representative is eligible to practice before the IRS and, if needed, check disciplinary status through the IRS disciplinary lookup tool. If you only want someone to receive information, do not overstate the authorization; if you want representation, do not understate it.

A useful hypothetical example: suppose the IRS sent a collection notice for two tax years, but your current Form 2848 lists only one year. Your representative may be able to discuss the covered year, yet still be unable to address the other one. That is not a technicality; it affects what the IRS can disclose and what the representative can do. The safest next step is to match the form to the actual notice before the IRS communication window closes.

Questions about Form 2848 and the scope of authorized representation

Does Form 2848 let my representative handle every IRS matter?

No. It only covers the tax periods, tax types, and authorities you list. It also requires an eligible representative who can practice before the IRS.

When should I use Form 8821 instead of Form 2848?

Use Form 8821 when you want someone to receive or inspect your tax information but not advocate, negotiate, or represent you before the IRS.

Can the IRS send copies of notices to more than one representative?

IRM 5.1.23 says the IRS can send courtesy copies only when the proper box is checked, and no more than two authorized representatives or designees can receive them.
