In Fort Lauderdale, FL, penalty relief starts with a records check, not a guess about fairness. The IRS will look at the penalty type, the notice or module history, and the documentation supporting why the amount was assessed. If the balance looks wrong, the first question is whether the penalty was computed correctly; the second is whether the facts support abatement under the right procedure.

Start by matching the notice to the penalty type

Not every IRS penalty is handled the same way. Some penalties are reviewed under reasonable cause rules, while others have narrower relief paths or no First Time Abate option at all. IRM 5.1.15 notes that Chief Counsel determined First Time Abate does not apply to the Intentional Disregard Penalty, PRN 549, or the Late Filing Penalty, PRN 550. Those penalties can be abated only on reasonable cause grounds.

That distinction matters if you are checking whether the assessed balance is correct. A penalty can be mathematically right and still be challengeable on the facts, or it can be wrongly assessed because the underlying filing record is incomplete. Before asking for relief, compare the IRS notice, the return or information return filing history, and any correspondence that shows what was filed and when.

Compare the available procedures before you request relief

IRM 5.1.15 says Form 3870, Request for Adjustment, is the general tool for full or partial tax adjustments and for penalty or restricted interest abatements when the Reasonable Cause Assistant is not applicable. For penalty-only requests, the IRS uses the appropriate Form 3870 ICS template. That means the procedure depends on the kind of penalty and the evidence available.

If the issue involves information return penalties, the records become even more important. The IRM explains that adjustments for PRN 549 must include the original Form W-3 and Forms W-2 attached to Form 3870, along with an explanation of why they were not filed timely. If the relief request is for a TIN-related penalty such as PRN 502, the IRS looks for proof of a timely solicitation for the correct taxpayer identification number and other reasonable cause facts. In each case, the key is to match the penalty code to the support in the file.

What records help prove the balance is wrong or should be reduced

Useful records usually include the IRS notice, the filed return or corrected return, payroll or information-return copies, mailing proof, correspondence showing a solicitation or follow-up, and any documents explaining the event that caused the failure. The IRM also says all documentation must be attached to Form 3870 for the penalty abatement to be considered. If the case involves an EIN, copies of applicable returns or a list of tax liabilities with the FICA breakdown may also be needed.

A hypothetical example: if a business received a CP 215 for an intentional disregard penalty, the file should show whether the W-2s and W-3 were actually filed, whether the filing was late, and whether the reason for the delay fits reasonable cause. If the records are missing, the IRS may reject the request. If the records show the assessment is incorrect, the request should explain that directly rather than relying only on a general hardship statement.

Use the right next step and keep the limits clear

For a Fort Lauderdale case review, the practical next step is to assemble the notice, the filing records, and any explanation documents before deciding whether to pursue correction, reasonable cause abatement, or both. If you suspect the balance is wrong, focus first on the module history and what was actually filed. If the balance is right but the penalty should be removed, the request must fit the penalty’s relief standard.

Do not assume that one relief path covers every penalty. IRM 5.1.15 makes clear that some penalties are not eligible for First Time Abate, and that documentation drives the decision. Also, an approval on one module does not automatically resolve other penalties on the account. The goal is to present the IRS with a complete, penalty-specific record so the agency can test the assessment against the facts.

Questions about Penalty relief depends on the reason and the record

Can I use First Time Abate for every penalty on my account?

No. IRM 5.1.15 says First Time Abate does not apply to PRN 549 or PRN 550. Those penalties must be addressed under reasonable cause criteria if relief is available.

What records matter most if I think the penalty amount is wrong?

Start with the IRS notice, the filed or corrected return, proof of filing or mailing, and any documents tied to the specific failure, such as W-2 or W-3 copies or proof of a timely solicitation for a correct TIN.

Do I still need to explain the reason if the IRS already has my forms?

Yes, if you are asking for penalty relief. The IRS needs the documents and the explanation showing why the failure happened and why reasonable cause applies, not just the forms alone.
