In Miramar, FL, an offer or hearing request can affect the IRS collection clock, but only if the request type, receipt date, and account history line up. The practical issue is not simply whether you asked the IRS for relief. It is whether the filing actually suspended the Collection Statute Expiration Date, and whether missing returns or incomplete records change that conclusion under IRM 5.1.19.

Start with the date the IRS is actually counting

Every assessed tax liability has a Collection Statute Expiration Date, and IRM 5.1.19 explains that the normal collection period is 10 years from assessment under IRC 6502. That date is the anchor for the analysis, but it is not always the whole story. If the IRS received a timely Collection Due Process hearing request, the statute can be suspended from the receipt date until the request is withdrawn or Appeals issues a final determination, including later court review when applicable.

The first document-led step is to reconstruct the timeline from the IRS account transcript, the notice that triggered the request, and any correspondence showing when the request was received. If you are missing a notice copy or a filed return, do not assume the date from memory. A missing filing can make the timeline unreliable because the IRS may be working from a different assessment date, notice date, or transaction code history than the taxpayer expects.

Separate an offer from a CDP request before drawing conclusions

An offer in compromise and a CDP hearing request do not affect the clock in exactly the same way. Under IRM 5.1.19, certain pending offers and the related appeal period can suspend the statute while levy is prohibited, and the same general principle applies to pending installment agreement periods in the situations described by the Manual. The important distinction is that the suspension follows the procedural event the IRS recognizes, not the label the taxpayer uses casually.

A hypothetical example helps: if a taxpayer mails an offer package but cannot prove when the IRS received it, and the account shows a later rejection notice, the statute analysis should begin with the IRS-recognized receipt and decision dates rather than the mailing guess. Likewise, a hearing request tied to a notice of lien filing is not the same as one tied to a levy notice; the IRM identifies different transaction codes for those events. That distinction matters when you are trying to determine whether the clock was paused at all.

Use missing filings to test the quality of the record

Missing returns are often the reason a collection statute review goes wrong. If one or more returns were never filed, filed late, or filed after the IRS had already assessed substitute amounts, the account history may not match the taxpayer’s personal timeline. Before relying on a claimed expiration date, confirm the filing status for the years involved, the assessment dates, and whether any pending request overlapped with a suspension period described in IRM 5.1.19.

This is also where joint liabilities require care. The Manual explains that some suspensions apply only to the spouse who made the request, so a joint account may need separate CSED review for each spouse. Do not assume that one spouse’s offer, hearing request, or relief filing automatically changes the other spouse’s collection clock. The account transcript and any CSED indicators are more reliable than a general recollection of what was filed.

Take the next procedural step before you trust the clock

The best next step is a document-led case review that builds a single dated timeline: assessment date, notice date, request date, IRS receipt or transaction entry, any appeal steps, and the filing status for each affected year. If the records support a real issue, you can then decide whether the statute was suspended, whether a notice was misread, or whether the IRS should reassess the account history. If the facts do not line up, you avoid relying on an expiration date that may not hold up.

In Miramar and the broader Broward County area, local public-records context rarely changes the federal statute question, but it can help confirm copies of filings or recorded notices when a taxpayer is missing paperwork. For IRS collection questions, keep the focus on the federal record. An IRS Taxpayer Assistance Center is not automatically the office handling your collection matter, and hiring help does not itself stop collection activity. What matters is the paper trail and the procedural posture.

Questions about An offer or hearing request can affect the collection clock

Does filing a CDP hearing request always stop the collection clock?

Not always. Under IRM 5.1.19, a timely CDP request can suspend the Collection Statute Expiration Date, but the effect depends on the notice type, timing, and whether the request was properly received and processed.

How do missing tax returns affect a statute review?

Missing or late-filed returns can make the timeline harder to trust because the IRS account may show assessments, notices, or suspension periods that do not match the taxpayer’s memory. The filing history should be checked before relying on any CSED calculation.

Is an offer in compromise the same as a levy release?

No. An offer can affect the statute in certain situations, but it is not a levy release and it does not erase the debt. Relief under an offer, withdrawal of a lien notice, discharge of property, and satisfaction of the liability are different procedures.
